Filing for citizenship after divorce

Hello everybody,

I just want to verify after doing a search in the forum. I am eligible to file for citizenship in January (90 days before my 5-year PR anniversary). I was married to a US citizen but we divorced in August 2010, amicable, no problems, etc. Now the question: Besides sending copies of our divorce decree, I don't have to send anything else right since I am filing on my own? Not even tax documents?

Correct as far as I know.

If you are applying based on 5-years presence, you do not need to send your divorce decree. Your marital status is irrelevant (though you do need to fill in the appropriate information in the forms).

I would probably still bring the decree along to the interview however.

Wrong! Check the following checklist: http://www.uscis.gov/files/article/attachments.pdf

Even if you are applying based on 5-year residency, you need to send in Proof that all earlier marriages ended (divorce decree(s), annulment(s), or death certificates(s)).

Always the issue, if you came here through marriage, did you just get married to come here? Will be questioned on that issue. Really bad if you remarried a person from your home country. If still single, will be questioned if that marriage to a US citizen was done in good faith.

Even feel the USCIS is responsible for this with that crazy K1 90 day rule, either get married in that short time frame or be mean and cruel and send that person back, easier to get married. Can't even have a some church marriages in that short period of time, want you to wait at least a year.

I was already here when I met her, I came to this country legally in 2000. We were coworkers and college sweethearts and then we got married, so all covered there. Do you think it would be a good idea to bring to the interview love letters, pictures, emails etc that show that the relationship was in good faith? I am still single smile.gif

With that extra bit of information, never married to come here, you shouldn't have any problems. 50% of marriages end up in a divorce anyway, we don't want that to happen, but if the spouse changes so drastically, really don't have much choice.

Worse advice I was given was to stay together for the kids, that was a huge mistake. Both my wife and I made mistakes when young, we dated for two years. When we learned we couldn't live without each other, then tied the knot. Never believed in soulmates until I met her, hope the same for you.

Well, I didn't get married to come here, I was on an F-1 visa, but was due to our marriage that I was granted the PR. And yes, that's the truth...I have never believed in "a soulmate," but rather in soulmates, one loses some in the path of life until finding one in the right moment at the right time.

Well, I didn't get married to come here, I was on an F-1 visa, but was due to our marriage that I was granted the PR. And yes, that's the truth...I have never believed in "a soulmate," but rather in soulmates, one loses some in the path of life until finding one in the right moment at the right time.

yeap, the office asked me why basically the marriage failed and I told her what happened and I had the oath ceremony the same day.

I appreciate you responding right away! Your case gives me hope. I am nervous about my interview, mainly because I divorced my husband a few months after the removal of conditions on my green card. I hope I am as lucky as you!

My case was exactly the same, we applied in February 2010 for removal of conditions. I received the green card in May and by August we were already divorced.

Do not worry, just tell the truth and that's it.
