I was married on April 26,2011 and filled I-485, EAD, I-130 received by USCIS on May 23,2011.

Done biometrics in July 2011. EAD receive in Aug 2011.

Attended interview on Aug 24, 2011,the officer checked all documents and photo albums and asked questions. (IO kept couple of photograph, copies of lease, bank statement, bills etc)

Then the IO handed me a paper which said we will receive a decission within 60 days. (IO took my I-94)

After couple days on Aug 30,2011 we received our I-130 approval letter (Till now the USCIS website for my I-130 shows initial review)

Till then We didn't receive any thing,I took infopass on Nov 11,2011 and the IO said my cas is in security review and they don't have the time frame. He said if you don't get any thin in 2 month take info pass.

On Feb 14,2012 I went again with info pass, this time the IO knows my attorney. She checked all files and said they gonna visit our home.(She took my I-130 copies to put in the file)

Untill now nobody visited our home nor I receive any information. My EAD is going to expire on July 2012 and I submitted for renewal.

On April24,2011 I opened a SR.

(I had an attorney but he is frequently out of country, and I asked him to withdraw as a counsul)

He withdraw on April 25, 2011.

On May 31,2012 We received a letter from the IO stating to submit I-601 for misrepresentation and gave me June 29,2012 date and time to meet the officer.

If anybody knows how to proceed Please help me out. I will really thankfull to you guys.

Thanks,

Ziauddin

Hire a new lawyer to help with the I-601. That's not DIY territory. Follow all instructions on the letter you received.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

wow... what kind of misrepresentation is yours, fake document?????. The Immigration Law allows the government to waive this ground of inadmissibility , but you have to show extreme hardship to the US Citizen. It's better to find a lawyer and he/she will be able to argue in the waiver social, financial, phycological and cultural issues.

.

Thanks Harpa.

Guys before predicting any thing please look at the fact.

- A year after the interview and 3rd Service request the IO send me this letter.( There is a bad reputation for this IO in NY office.)

- I checked with at least 3 immigration attorneys, about this letter. This letter doesn't mentioned what type of misrepresentation is this.

- One attorney suggested me to go to the Federal Plaza and talk to the supervisor, the IO might just wanna show some response to the CR, what's why he send this letter. The letter just stated to submit I-601 waiver for misrepresent ion and drop off the documents to this IO on June xxx and at xxxx time.

- In my case I never been in any fraudulent activity. I came on H1B( Job) Visa and I extended couple of times. My H1B is expired in April 2010 as I didn't extend as the company I worked laid off.

- I didn't have even a parking ticket in my record.

Hope you guys understand the situation. I contacted a attorney 'TNT lawyer.com' who has a good reputation. Mostly attorneys asking 5 to 6K.

Thanks.
