My wife and I are married for less than 2 years . We filed for AOS- our case was transferred and later approved without an interview. We received a Green Card Stating that my wife had received a PERMANENT RESIDENT CARD ( The card reads PERMANENT not CONDITIONAL)valid for 2 years . On the letter that came with the card its says clearly that if you received a conditional card you must file to lift the conditions 90 days before it expires with form I-751 . If your card is a Permanent resident card ( in our case Permanent is clearly written on my wife's GC)( No where on the GC is the word CONDITIONAL WRITTEN) you must file form I-90 only to renew the card and that your status as Permanent resident will not be affected. ----------------------------------------- The question is .......... Did we get lucky and receive a permanent resident card after my wife's AOS was approved ? or is the card conditional even if it clearly says on it PERMANENT RESIDENT CARD ... if this were the case then the explanation on the letter that came along with the card would make no sense ........

THanks for your help in advance JCB

The only thing conditional about the green cards that you receive when being married less than 2 years is that they expire in only 2 years. The cards do not state conditional on them. They are a permanent resident card, same as the 10 year card, only they expire in 2 years. You must file for removal of conditions 90 days before it expires. Removal of conditions is to prove you have a legit marriage and did not marry for the purpose of immigration only. Do NOT send in the I-90 to have it renewed.

I would suggest you go ahead and file the I-751 form when it's time because you were not married 2 years or more as at the time your card permanent residency was approved, so it's plain as day. You were issued the standard conditional green card for couples that were married less than 2 years prior to the issuance of the card. If you are still confused, make an info pass just so to ease your worries. Stay blessed brother!

You said your card expires in 2 years, correct?

There is some confusion on this board and around. A "conditional" PR is still a Permanent Resident. When your GC expires is the important item here. You say it expires in 2 years, which means she has a conditional card, and you will need to remove conditions in 2-years.

A conditional resident has all the same rights and responsibilities as a normal Permanent Resident. The only difference is how you get a new card. The cards look identical, except expiration date and "code."

CR6 will be your Category, it means CONDITIONAL RESIDENT, and the card will expire in 2 years.

Ummm nup. My category (AOS from a K1) is CF1. Meaning "conditional family 1" category. CR6 is for spouses of USC's yes, but from tourist visas etc most like. CF1 is for K1 AOSers (see here: http://www.trackitt.com/uk-discussion-forums/i485-eb/125892951/green-card-category-codes)

Yep. I would think someone AOSing from a K3 would be CR6. Here is a more detailed link: http://www.uscis.gov/ilink/docView/AFM/HTML/AFM/0-0-0-1/0-0-0-26573/0-0-0-32054.html

My husband's came with cat CR6. I searched all through VJ and found that others adjusting from a K-1 have also received that category code. There doesn't appear to be any difference about it, or troubles with it, so I decided to leave it as is.

Weird... it should be CF1 but exactly, as long as it's conditional and all the other info is correct I'm not sure the rest matters (and I certainly wouldn't waste 6 months sending off an I-90 :S)
