Hello VJ Members,

I just finished my annulment, so we are about to send our application...my fiance visited last January 2011 after his visit he was on and off from work, and he did no meet the required poverty level last 2011. And now when we are about to send our application he was laid off from work again...he worked for 6 months on this last job from november 2011 to may 2012..My question is will we be ok if he send it now even though he is not working and find a work later and make sure he has work before my interview? We are so confused and we dont want to take the risk of any possible denial in the future...your answer is highly appreciated...

Since you don't have to show any income at all in this initial petition, the I-129F, if he thinks by the time your interview will come, he will be working again, you might be fine. It will take four to five months until you receive the next notice of action anyway, so you have some time, even if he submits now. I think better to go ahead and submit now, it'll be more important for him to have a job and be working when you do your interview. So when you get your letter saying you can schedule your interview, if he still isn't working, then you can deal with that at that point.

Right now, when you submit your I-129F, it shouldn't really make any difference, I don' think at this phase they are looking at his income yet at all.

But maybe others have other thoughts too.

I'd say much better to get the petition in, and get the ball rolling now, since this phase is the longest one of waiting, better to get started!

Some CO requires three months of pay stub. If he thinks he can get a job soon enough to suffice the requirement for your k1 visa interview, yes, you can file the petition. Your draw back is timing on how soon he can get a job and how soon your petition get approval. K1 visa in the Philippines have higher denial due to income requirement, no assurance too that CO will accept co-sponsor.

11/25/2011 - Received RFE

11/28/2011 - Sent response to RFE

01/13/2012 - Ordered card production (Approved)

01/19/2012 - 10 yrs GC received
