hello,

i hAVE BEEN an F1 student for 2 years. i just married my wife two weeks ago and she is trying to file for me so i can get my green card. I dont have any idea of the step to take. And also she is 21, is she eligible to file for me?

i attend school here in the USA

4/04/2012 (Day 13) - Received a letter for biometrics appointment for 4/20/2012.

5/03/2012 (Day 42) - Status online changed to interview, scheduled for June 11
5/16/2012 (Day 55) - EAD Card Production, online status update
5/24/2012 (Day 63) - EAD Card in the mail
6/11/2012 (Day 83) - Interview, approved on the spot

05/19/2014 (Day 0) - Mailed I-751

05/27/2014 (Day 8) - Received NOA1

Yes. Your wife's age doesn't matter for petitioning for you, although you do need a sponsor in the U.S. that makes enough money under the guidelines to sponsor you, if she does not.

The process is that you submit I-130 and I-485 at the same time to adjust your status to lawful permanent resident. She fills out and signs I-130 because she is the U.S. citizen petitioner, and you fill out and sign I-485 to adjust your status. In addition, your wife needs to fill out and sign I-864 which is an affidavit of support. If she doesn't make enough money to sponsor you under the guidelines on I-864P, you will have to find another co-sponsor also to fill out and sign I-864. In addition, you have to get a medical exam and certain vaccinations from a doctor on the list of civil surgeons and submit Form I-693.

You can't travel outside the U.S. or work unless you also send in optional forms I-131 and I-765 to get an employment authorization document/advance parole.
