Its unusual to interview the children before the parent. even if the children are granted a visa, they will have to travel WITH their mom or JOIN their mom later.

I'm so glad someone asked this question!! I'm sort of going through the same thing. I have called USCIS 3 different times and asked 3 different Tier 2 people if this is possible. They all have said that while it is rare it is definitely possible. All you have to do is prove a bona fide marriage with their mom and prove she is indeed their mom!

I wish you the best and look forward to hearing what happens! Please please please come back and give us the results!

Curious... Why do you say that they will have to travel WITH their mom or JOIN her later?

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

More details.. We are living in the US together. They are all three here illegal.I requested that my wife's case be delayed because of the band that she will receive and we will have to do the waiver appointment. Hoping that Obama's new waiver law will go into effect the first part of 2013, we decided to wait on her case. The children however still have their interview date and I can not get a clear answer from immigration on the chances of them granting the children their visas. We spoke to an immigration lawyer and were told to go ahead with the children there should be no problems, however, nothing is for sure until we get to Mexico and through the interview. I am nervous about it because once we cross the border we are there and no way back home without visas.

Just wondering if we should wait for the children until my wife goes together with them.

Thanks for any information that anyone might have in this type of case.

We have been married over two years and have lived together for four years.

The children are 7 and 11 years old.

The children will not face a ban. Children under 18 don't accumulate unlawful presence.

You're married to their mother. They're your step-kids. They're eligible for a visa. Their mother doesn't need to get a visa first. As long as you can prove your relationship to the kids then their visas should be approved. However, since a visa is never guaranteed you should have a backup plan, including a place for them to live in Mexico if their visas are denied.

Has anyone had any experience with bringing a stepchild to the US if their mother is in the US illegal?

My two stepsons have their interview in about two weeks. My wife will not have her interview for about six more

months.

Should this go easy for us or will the counsulate insist that my wife get her visa first?

My wife and stepsons are living in the US with me. We have been married for over two years and the children are

both under 12 years old.

Someone on this forum mentioned that someone had brought their stepdaughter here and her husband was here illegal.

I can't find that topic here.

Thanks for any advice.
