I 485 letter of employment

I am getting my adjustment of status packet ready to mail out in a couple days.. I an unsure of one thing though. My husband filed taxes in 2011 and 2012. He made more than enough to sponsor me. But do I have to send in the most 3 recent years tax return? Or can I send in those 2 years? Also can anyone post a sample or explain what the employment letter should entails?

06.08.12 - AOS mailed
09.18.12 - Interview.....Approved!!

ROC- Divorce Waiver
05/09/14- I-751 packet mailed to CSC
05/12/14- NOA1 Receipt date
07/01/14- Biometrics Appt

08/11/14- RFE received

09/08/14- RFE response received by USCIS

09/22/14- 10yrs GC Approved!!

We didnt send 3 years of tax returns for my husband. We only sent tax return for the most recent year.

But, even if you only send for one year, you still need to fill in the gross adjusted incomes from all three tax years in part 25.

So for your husband that would gross adjusted income from 2011, 2010, and 2009 tax years.

You don't necessarily need an employment letter. But you can send it if you want.

This letter is to confirm that XXX has been employed with XXX company since (date) on a full time basis as a (position/job title).

His annual salary is $xxxxx.

Adjusted Gross is only used if you filed 1040EZ.

But if you filed 1040 or 1040A, Gross (Total) Income wil be considered.

No employment letter is needed if the total personal income (line 22) on 1040 is more than required minimum.

I disagree. The I-864 information page at uscis.gov says that all sponsors must have proof of current employment. It is true the instructions on the form say you "may" include it, but the final checklist on the webpage says you need it.

OP - if you read the instructions, you can either send in 3 years of tax returns or 1 year of tax returns.
