Joint sponsor using income from property

Hi

Myself and my US citizen spouse are preparing to file for I-130, he does not make the minimum income requirements but one of his friends is keen to be our joint sponsor. She lives with a friend but is not married and has no dependants so her household size is 2! Her principle income is from three properties that she jointly owns with her friend. My questions are:

would her friend have to file I-864A as he co-owns the property?

other than the tax transcripts what other proof would she have to supply (proof of property ownership, copy of tenancy agreements with renters, valuations, or bank statements)??

December 2009 - Spent 5 months together in England

May 2010 - We both went to America when we spent 2 weeks together

August 2010 - Spent 3 weeks together in America

December 2010 - Spent 5 months together in England

May 2011 - We both went to America together where we spent 2 weeks together

September 2011 - Spent 3 weeks together in America

December 2011 - Spent 5 months together again in England as with the previous years!

April 2012 - spent 2 weeks together in America, got married on May 8th in America!!!!!!!

The sponsor would complete form I-864. The petitioner also completes an I-864 regardless of income.

The friend cannot combine income with the potential sponsor. For the sponsor to have a household count of 2 does that person have a dependent child? The property co-owner friend would not be counted in a household calculation.

How does the sponsor file their taxes? If it is classified as a type of self employment then their income number would be line 22 from their 2011 federal tax return. If they are classified as an wage / salary earner then recent paystubs and an employer letter would document the current income.

Thankyou for the very quick response!!!!!

I believe she files as a single with no dependants therefore the household income of 2 would be herself and me as the potential immigrant!

She is not employed so to speak so there are no wages just income from the properties that she and her friend rents out! All properties have tenants in!

If she files her taxes "as a type of self employment" would the income number on line 22 be sufficient or would she be required to supply further evidence of her income?

Also as she co-owns the property with her friend would we need anything from her friend to show he supports her sponsorship or me?

From what you are saying the income number is likely line 22 from the 2011 tax return. If that number is less than the $18,912, assets can be used to reach the required income amount. That would require a bit more paperwork (recent valuation of the asset along with proof of asset ownership). Using a co-owned rental property may not be accepted. Talk with your sponsor and ask the line 22 question. If it's greater than $19K you ought to be fine.

I have a question about AOS. The person who wants to help my spouse and I is the best friend of my husband. He has been in the U.S. going on for 3 years now. His wife used a joint sponsor to petition him to U.S. Can this friend still help us despite him being on someone else income?

This is essentially correct but if assets need to be used and the assets are jointly owned, that would be highly complicated. Best to find a sponsor with a line 22 or employment income comfortably over the minimum for their household. Joint sponsors who barely meet the minimum are not likely to actually be available to meet any I-864 related obligations.

Facts are cheap...knowing how to use them is precious...
