Definitely wait for the RFE. USCIS receives a ton - several tons, in fact - of paperwork. Each piece is processed and sorted at a mail center before it is sent on to a processing center. The mail center checks to see if the money enclosed is correct and if not, they will return the package with the notation to send the correct amount. If you send a second piece of correspondence that arrives even a day later there will have been thousands of pieces of mail received in between. Mail is sent on relatively in order of receipt so you would have one package waiting to be processed - then several thousand envelopes later would be your following birth certificate. There is no way that you can ensure that the same adjudicator is going to get both packages, and there is only one thing that connects them - the name and address. USCIS doesn't organize paperwork by name and address but by case number.

When the adjudicator gets your first package and reviews it for completeness he/she will see the birth certificate is missing. He/she will issue the RFE that has the specific case number on it and a different address that will return the requested information directly to his/her location. The file is set aside in a holding area awaiting the return of the missing information. Once they receive back the requested RFE (the letter requesting the information needs to be returned with the information), the original package is then located in the holding area, the documents matched up and the processing continued.

If you have a second envelope containing missing information sent, a case worker will get the envelope. It will require them to try and locate where the original envelope is. They need to do a search by name when the system is set up to search by case number. They may find 25 files with the same name, so they set the package aside for now until someone has the time to do the necessary additional search to determine which of those 25 names this item belongs to. It may never, in fact, get matched up,but guaranteed, the RFE with its requested document will get processed far faster than the additional document send just one day later.

So, wait for the RFe, respond to it by return mail and you will have lost at most a few days in the processing.

As said above, the EAD and AP packages are separated out from the AOS and are processed individually and separately. They may well be processed before someone has even got around to looking at the AOS package to realize the birth certificate is missing and send out the RFE.

If you get an NOA1 (instead of them sending the whole package back), I would mail the BC then with a copy of the NOA1 and an explanation. They might not accept it and might still issue an RFE but perhaps it'll get matched up & doesn't cost much to try.

Thank you for that elaborate answer :) are you a USCIS officer..? :)

the only thing is that when i called uscis and told them about it they told me that every part of the AOS package would be delayed if something is missing..? but i honestly think that they say what they assume sometimes so.. we will see :) and they also said that if i was to get an RFE.. wich is most likely it is 60 extra days.?

No she's not. She's a very knowledgeable mod on here.

Yes everything is paused while you reply to an RFE (it also says that on the RFE). The length of delay depends on how long you take to reply to the RFE. I agree with ceadsearc that when you get the NOA1 I would send the birth cert COPY with a copy of the NOA1. I highly doubt it would be 60 days.

So i got the NOA for both the I-485 and the EAD today... :) should i really send the birth certificate now...along with a copy of the NOA ? because i did send the extra package the day after i had originally sent the whole package...

No she's not. She's a very knowledgeable mod on here.

Yes everything is paused while you reply to an RFE (it also says that on the RFE). The length of delay depends on how long you take to reply to the RFE. I agree with ceadsearc that when you get the NOA1 I would send the birth cert COPY with a copy of the NOA1. I highly doubt it would be 60 days.

They either met up or didn't. So you can try sending a copy of it with a copy of the NOA1, bearing in mind it STILL might not meet up, or you can wait and see if you get RFE'd. Up to you.

ofcourse im hoping they met up but guessing that it is a long shot.. but one thing is tho..? i sent it in on may 30:th and just got the NOA yesterday...6-10-2012... isnt that quite long for a NOA 1 ? thats why i was thinking maybe they did try to match them together..?

They either met up or didn't. So you can try sending a copy of it with a copy of the NOA1, bearing in mind it STILL might not meet up, or you can wait and see if you get RFE'd. Up to you.

You GOT the NOA1 dated 10 june, but there would be a different date on it. I got mine on the 13th April, dated 6th April. So no, I don't think your NOA1 took a long time at all.

It's great it was so quick but no it doesn't mean you're not going to get RFE'd.

Also, taking it to the bio appt is pointless because they don't have your file so they won't take it.
