I messed up !

I had a VERY busy day and was big time stressed in getting our AOS package down to the postal office in time to send it away before they close... when i got home i saw that i had forgotten something ! my birthcertificate was on the table !!?

My question is if anyone has any knowledge/experience on sending a missing piece of an AOS package the very next day as an ADDENDUM very ergent type thing and NOT having to wait for an RFE = 60 more days of waiting... :(((

It was a very stupid mistake i made and i called USCIS to talk to them and the first lady i talked to was not helpful at all and said i would have to wait for the RFE and that ment delaying our application about 60 days.. then i talked to another who was more receptive and said that i can allways try and to attach as much evidence as possible to wich case it was about.. a.s.o

You have nothing to lose, except the b.c. copy and mailing costs, so if you really want to - go ahead and mail it to the USCIS. But, it is my understanding that as the service center receives your package it is first checked to see if the correct payment is enclosed. And, if so, puts your package in line with everybody else. And, when someone gets to your package, 6 months or more later..., it will be noted that your b.c. was missing and you may receive an RFE. But, I don't think the second package you send with your b.c. will be included with your initial package. That would require someone with knowledge and skills to put your two packages together. I could be wrong...

The biggest issue right now is the EAD, we dont want ot have to 60 EXTRA days for that ! do you think its possible to just send in another EAD application and pay the $380 for the EAD ?

We sent in the I-765 with the AOS now and that will be draging along with the rest of the application, The Green Card is not the most important thing now.. its the EAD and me beeing able to WORK !

I don't think RFE for a birth certificate will add 60 days to AOS processing, but with USCIS you never know.:blush:

I-765 itself does not require birth certificate evidence, so as long as your applications are accepted and NOAs issued, this omission should not make your wait for EAD any longer.

On the other hand, because the birth certificate is an initial evidence for I-485, it may just happen (although IMO is unlikely) that your entire AOS package will be rejected and returned to you.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

So your EAD didnt get delayed? how long did it take for you to get it ? and how much longer was the rest of the package delayed =?

I received an RFE for birth cert but it did not delay my EAD. So don't worry.

Wait for the RFE, simple fix and should only delay if any by mailing time. The biggest hassle is checking, checking and rechecking all the paperwork.

If you get an NOA1 (instead of them sending the whole package back), I would mail the BC then with a copy of the NOA1 and an explanation. They might not accept it and might still issue an RFE but perhaps it'll get matched up & doesn't cost much to try.

OUR TIMELINE

I am the USC, husband is adjusting from B2.

ADJUSTMENT OF STATUS

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

11.02.2012 - Mailed I-751 packet to VSC
11.08.2012 - Checks cashed
11.10.2012 - NOA1 received, dated 11.06.2012
11.17.2012 - Biometrics letter received for 12.05.2012
11.23.2012 - Successful early biometrics walk-in

05.03.2013 - Approved! Card production ordered!
