The attorney I spoke with and also a very competent VJ member informed me at interview they cannot question intent at interview either!

I read your response and, as I stated, merely saying "intent is forgiven" is inaccurate and incomplete. Also, I disagree that "they cannot question intent at interview either", and I know of others who have been asked about intent.

If USCIS policy was "intent is forgiven", the IR-1/CR-1 route would become mostly obsolete as all spouses of U.S. citizens who could would immigrate under the VWP or with a B-2 visa. As you can see, that has not happened.

If the OP is not questioned, that does not prove anything other than intent and fraud were not raised in this case. It does not prove that it is never an issue.

I count at least 5 forms plus a form provided by a civil surgeon when the alien has a medical examination.
