I guess im just going to have to wait it out sinse my lawyer is on vacation until june 15th. But can amyome suggest until what date should i wait for any action?

In most case, you will see your check cashed about 10 days to 2 weeks (business days). Not everyone would send it certified or with a tracking number; regular mail is sufficient; of course, most of us here would have some sort of tracking mechanism. In our case, the check being cashed is the mechanism.

As others have said, beware of lawyers, there are good ones and bad ones; the bad ones could strung you along for more money or simply do the minimum they can.

Reality is, you don't need a lawyer unless you have a fairly complex case; your original post suggest it is not.

If you have already paid a fixed fee and that is it until you get approval of the petition, might as well use the lawyer as long as he/she at least does the minimal; but note that really he/she is in exact the same position you would be if you had gone alone (except that he/she is charging a fee).

At the very least, if I were you, I'd get a copy of the entire package as sent; in case you need to do it all over. If this is a difficult lawyer to deal with, ask for a copy under the reason that you want to review averything one more time to be absolutely sure the applications are correct and the package is complete.

If you are paying installments, you might be stuck. In that case, make sure you get a reference number from lawyer and/or USCIS; if from lawyer, validate that it is correct (with USCIS). It is not unheard of that some lawyer take your reference number hostage until payments.

Last but not least, ask ask ask all you need in this forum. The collective experience of the people here is vast and bigger than any lawyer; and most of us here have done it and the ones who have run into issues/problems (RFEs) have resolve them with the help of others.

If someone here feels you needs to consult an attorney, that someone will say it; and it will be validate by others. Never understimate the power of really well motivated people in this forum.

Not to make the matter worse, but all you've been saying sounds so shady. I have a good feeling that he's running with everything you've got. Even "on vacation", they should be reachable and assure you and be clear of the process they are doing for you, and the secretary SHOULD know all about it since she is the one that sent it. I'm sorry it doesn't sound like this is going to end well.

Just prepare another application and your VJ friends here will help you through it!!!

DON'T WAIT!!! Start making another package while you're waiting. If your lawyer turns out to be a scam, you are ready to send your new package. You have 15 days to get it done before you hear back from him anyway.

Seriously. It would bother me to be paying someone for a service they can't even give me information on. How does nobody know when it was sent? Not even a date? And no tracking numbers, nothing, to prove that it WAS sent? Sounds bizarre to me. They should be able to give you information. It's YOUR paperwork and YOUR money.

The reason why i used a lawyer was because i have been undocumented sinse i was 12 years old. My father who is the petitioner is currently serving a life sentense in prison. I found no way around doin it myself. I checked the state bar for this lawyer and everything is A-ok with him as far as him being an acitve lawyer. The lawyer did send the paperwork to my father in prison to have it signed. My background is this i came in illegaly with my mother at the age of 6 from Honduras, at the age of 10 my father married my mother and filed our i-130 which was immediately aproved. We didnt move forward with the rest of the procedure because of financial difficulties. My father gets sent to prison for 25 to life for attempted murder in 2004. Up until last year we didnt know we couldve been legalized a long time ago. So now were trying to do everything we could and thought it be best to file with a lawyer. But im going crazy just thinking if im making the right moves. Im only 22 and i just dont know where to proceed. Weve paid our 1070,1000 penalty, and biometrics. The checks havent been cashed. But the 1500 that we paid our lawyer have been cashed. (sigh)

See if you can get the exact date that the package was sent off and ask how it was sent- USPS, UPS, regular mail,priority mail, etc. If it was sent with any sort of tracking system, (priority mail, certified, etc.), then see if you can get the tracking number to see when it was delivered to USCIS. It can take several weeks before the check is cashed and the NOA1 with a case number generated so it is really too early to get worried about problems. Your lawyer does need to do a better job of keeping you informed,and unfortunately, this is a common problem. You should be able to speak to a secretary or an assistant rather than the lawyer directly and they should be able to get this information for you. Don't panic, yet. The lawyer might be on holidays but he may still have staff working in his office and they should be able to give you the specifics of when the package was sent,how it was sent and if it has any tracking number with it.

Katrhyn ive already asked when was my package sent and he said sometime the week prior to may 22 when he gave me a call. When i e-mailed him to ask him if he could provide me with a tracking number he said he didnt have one amd that he was not sure of the exact date that he sent my package on. If his intentions were to just take my money then the money orders wouldve been cashed right? On the other hand his assistant is worse than him . Very rude and hostile even on the reviews other people aknowledge that . when he answers the phone he says "hello" not the typical greeting for a lawyers office. He is not helpful at all and is unwilling to answer any questions always says hell have the lawyer call back. About 3 weeks ago this assistant had called me and said the lawyer was ready to send my packet and he needed "the medical,my school records, my letters from my father and visitation logs,fathers birth certificate" all of that i had just given to the lawyer a week prior! He has all the originals which my mom was really pissed off at because she said those are important papers that shouldnt be floating around! I never heard back from them and after a whole week of worrying my #### off about that and trying to get in contact the lawyer calls, and says hes sent the aos already, and hell need my school records again soon because uscis will be asking for them! Ughhhhh im so frustrated.
