My husband filed I-130 for me and for my kids last month. I am here in US and waiting for he approval of my AOS, etc. I promised my son for a trip to Orlando Disneyland if he'll graduate in Elementary and he did it. He got a B1/B2 visa and will be his first time travelling to US as unaccompanied minor. We bought him a ticket already and just wondering if anyone here had the same experience before and was there any problem in the POE?

I am confused. Your husband filed I-130, but you are already int he USA, but your kids are not?

If you are Adjusting Status from a tourist visa or similar, and your kids are not currently in the USA, I think the chance of your son ebing allowed into the USA on a tourist visa are slim to none.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

oh thank you for your answer though I rebuke that.. :-) sorry for that.. but I would need a reply from someone who had actual experience or know an actual experience.

There are plenty of people here in VJ who have had similar experiences. Penguin is correct. If the CBP officer at the POE discovers that his mother is currently adjusting status based on a concurrently filed I-130, and there is an I-130 currently filed on your son's behalf, there's no way they're not going to think he's going to try to adjust status after entering the US. Since there's very little they can do to about preconceived intent after the alien enters the US, they do everything they can to detect it and stop it before the alien enters the US. I think you'll be extremely lucky if he's allowed to enter the US.

Being denied entry at the POE can be quite traumatizing even for an adult. Given that this will be his first trip and that he will be an unaccompanied minor are you sure you want to risk him going through this? I know it's not your first option but you said there is an I-130 filed for him, why not wait until he comes with his IR2 visa?

On another note won't he be starting his new school year very shortly - like in the next few weeks?

this is really his request more than a year ago and promised me he'll study well once he gets back. He's enrolled already and was allowed by the school to be off for two weeks.
