My husbands I-130 was approved May 17, 2012 :D. It took 4 months and one week and was processed at the CSC. Now Im trying to do the I-864 and am very confused.

I do not make enough to sponsor him. I need my step dad to be the 'joint sponsor" is that correct?

My step dad doesnt make a great deal of money, is it smart to also add my mom as a sponsor?

Is everyone on the same I-864 form or do they need to do seperate ones, each my mom and step dad?

Do they do an I-864 or an I-864A?

Do they need letters from their work stating they are still employed? My step dad is retired. Im not sure how I could get a letter like this and pay stubs.

Do they both need their pay stubs for the past 6 months?

Thank you for reading!

Start by downloading and carefully studying the I-864 instructions and the affidavit itself. If your step dad earns enough from "employment", then that's probably enough without getting Mom involved. If just you and step dad, two I-864 forms. If you add Mom, she provides the I-864a.

Thats what I understood from the instructions. They are just a little confusing. I file an I-864 for myself, then an I-864 for my step dad and an I-864a for my mom and state on my I-864 that I am not a sponsor for my husband and have two joint sponsors, correct? My step dad made more than enough but he JUST retired a few days ago and his income has gone down. I dont know if they'll look into that or not. The form doesnt seem to ask. It just asked where you work and if youre retired.

I wont need paystubs if I have W-2s and his tax filing information, correct?

You as the petitioner are always the primary sponsor regardless of income. Have one parent do the 864, the other do an 864A to combine their two incomes.

Current and continuing income is what is evaluated, not past year's income (Except for a self employed person). Current income is typically proved with recent paystubs and an employer letter. A retired person would show proof of retire income (pension, Social Security, etc.).

On your I-864, you check the box indicating you are the petitioner. Although unqualified, you ARE the primary sponsor.

You need to look at the questions on the form more closely. Present tense questions are to be answered in the present tense. The only past tense questions are about past income from tax returns. Current income IS what it IS, not what it WAS.
