I-134 Affidavit of Support

Hi all,

Just a quick question - my fiance just filled out the Affidavit of support. He is currently unemployed therefore he has no income however he does have approximately $20,000 in savings, $45,000 in stocks and about $550,000 in cash/money in his trading account. My question is will this be sufficient for support? Most of his money is in assets (although it is in cash, not invested)

I know this is more than enough for 2 people to live off on but i'm worried that they only look at income rather than assets.

Yes, you can use assets only. They are counted at 3 times what is required for income. So, since you only need $18,912 in income for a household of 2, then he only needs to have at least $56,736 in liquid assets. It is good that it is in cash. They require assets that are easily converted to cash without causing any hardships for the sponsor. Just make sure he provides solid proof of the assets he claims on the I-134.

I would like to highjack with another I-134 question.

Do I list what is in my 401K? Or is that considered assets that are not accessable? My income is well over the requirement and I've been at the same company for 24 years so do I really need to list all my stocks, bonds, assets, etc?

No. If you meet the income requirements, you don't have to provide any information about stocks, bonds, assets or anything. Simply include your income and back it up with supporting evidence and you're good to go!

Whew! Thanks! I have stuff spread out in seveal accounts and wasn't looking forward to contacting all those institutions to get formal letters, etc. One less thing to stress about.

I already have my letter from work and my Tax docs out and ready...even though I have a long wait.

Yep, you just use the employment letter and recent pay stubs to prove your current income. No need to list any assets at all if you make more than enough with income alone. Seems weird to leave parts of forms blank since all the others for immigrations say not leave any questions unanswered, but in the case of this form, it is perfectly okay to leave the whole assets sections blank.

Thanks for the reassurance. Yeah, leaving blanks was bothering me after the whole "N/A" "None" discussion on the I-129F.
