In my case it took 2 months because we didn't attach a US notarized copy of the passport. We got a letter a month after we first filed the application and then sent US notzrized copy of passport on May 1 and ITIN got assigned on May 25.

Did you send a US notarized copy of passport?

Yes, my wife went to local IRS office in Fayetteville and they notarized the copy of my passport and later it was sent to main IRS office in Texas.

Not proven accurate when you file paper with ITIN application.

Lord, ain't that the truth ! I watched the date slip for 3 weeks. I was watching that status thingie religiously, thinking the data was accurate. Made many phone calls after the first date slipped, finally found a 'specialist' who gave me 'general flow' processes and a forecast for when it might actually come across.

On our stuff, though, I must note that is different calendar when one isn't filing during tax season.

File outside of tax season? Then is different schedule, different calendar - to me it seems slower, an additional 3 to 4 weeks for our stuff, when folk who filed return + itin app during tax season were in/out in about 5 weeks total (where for our stuff, was about 11 weeks)

whew.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I have one very important question, please give me your experience and/or opinion?

I am married six years a go and been working in US in H1b, I got my green card at the beginning of this year in EB category. However, my wife has never been in US and I filed her follow-to-join (I-824) form at USCIS and waiting to get her here. She never been in US at all. I went ahead and filed my 2011 tax return as "married filed jointly" along with her ITIN application. It has been more than 2.5 months and heard nothing from IRS. I called them and they told me that the ITIN is suspended but they could not tell me the reason. I am suspecting the reason for the suspension is that my wife is not illegible to get an ITIN. So please try to answer my question based on my situation:

1. Am I eligible to file as married?

2. Is my wife eligible for ITIN number?

3. Should I file amendment to correct the filing status to "Single" instead of "Married filed jointly" ?

Your help is much appreciated!

1.yes

2.yes

3. no

But do find out why the intake was delayed, aye? I know of two reasons:

a. letter signed by both of you, telling the IRS that both of you elect to have her considered as a resident alien for tax filing purposes, wasn't included or

b. proper ID wasn't submitted with the ITIN application.

What step are u in the process??

1. You can only file as MARRIED, thats your maritial status at this time

2. YOur wife is eligible to file ITIN ( w-7). what did she put the reason to file W-7?? If i still remember, there were 7/8 reasons to file, b should be reason to file w-7 on your case.

3. You can't amendment to Single but your can file as " Married filling Separately" and you dont have to worry about w-7.

W-7 itself is not suppose to be complicated but mine was also rejected and went through the whole visa journey without filling W-7. she should be here ( USA) by next week and when she gets her SSN, I will do amendment on my 2011 tax filling.

good luck
