Three months ago I filed for adjustment to my status to become a permanent resident (I-485) and for employment authorization (I-765) along with all the other required documents (I-130, I-864 etc). Everything was going fine, and I was in the believe that my employment authorization should soon be on its way to me, until a couple of days ago that I received a letter printed on pink paper saying:

This office is unable to complete the processing of you Application to Register Permanent Residence or Adjust Status, (Form I-485) without additional information. Please submit the information requested below.

It then goes on to list form I-485, and all the required documents that go with it (tax information etc). It also says that my work authorization will not be processed until 90 days after they receive the I-485. Now I know that they must have received it, as I mailed it along with the I-765 and I-485 and they have acknowledged that they have received those documents.

I then called customer services and spoke with a supervisor and asked why I would need to send in the form again, and if they had lost it, and she would not answer my question, only answering that if I don’t do what it says on the letter then my application will be rejected.

Does this seem fair! If they have lost it, all I ask is that they admit it, and don’t penalize me in not processing my employment authorization until another 90 days.

Has anyone else experienced this? Any ideas as to what I can do?

this sucks. unfortunately, we are dealing with government dolts and there's very little you/we can do. just take it on the chin and send in your papers again.

did they lose your medical? I would be seriously pissed if I had to pay for that again, unless you can go back to the clinic and get them to duplicate your results given your situation.

Man that sucks, my commiseration. Sadly, I am not surprised. :(

Did they cash the cheque for the I-485 processing? If they did, then you have proof of submission I assume.

If not then my two cents is: forget investigating the whereabouts of the documents and just submit another asap. To do this you may have to get duplicates of the medical info you received from the doctor. Include in your cover letter what happened the first time around.

Do not worry about the 90 days too much. I received an RFI requesting submission of more of my wife's pay slips. We did so and I received the EAD card about 20 days later.

Although this is indeed irritating, you are best to re submit the paperwork they have requested as soon as possible and try to forget your feelings of annoyance. Anything else is likely to turn out to be a waste of your energy and is unlikely to achieve a different result than the position you are currently in.

Hi James,

What has happen to you sucks but there is nothing you could do but re-submitted the package again. Did you make two copies of the AOS package? Hopefully you did, this is why I always make copies of everything I submit. If the government would run a business they would be out of business before they begin.

I have seen this happen to a couple VJ members and they have posted their experiences, maybe you could do a search but I do not remember if they post before VJ change its format back in about February 2006. I want to wish you luck and send everything as soon as possible. :yes:

What a nightmare! Talk about your worst fears coming true. Call them and ask them about the cashed check, there is no WAY you should have to pay again, that's just wrong. And definately indicate that this is a replacement submission on your cover letter and envelope.

Did you get an NOA for the AOS?? Would seem to me if they have that then that is proof you submitted an application, right??

USCIS.....they need :help: !!!!!! :angry:
