You really think I will have to show proof of rehabilitation from something that happened over twelve years ago? That is a little over board

Depends on the substance I suppose.

If it was a drug harder than marijuana, then it was always my

understanding that one would be automatically ineligible for

a visa. However, our I-130 was just approved, and my husband

was arrested in 1996 for (misdemeanor) possession of methamphetamine,

spent 30 days in jail, then deported.

He was also charged with check fraud when he was in the states, but

never convicted and there was never a court hearing, because they'd

already sent him back to the UK.

The foreigner's criminal record is not a consideration in petition approval. This is an issue only at the Consulate. An approved I-130 means he's eligible to APPLY for a visa, not that he's eligible for a visa.

Facts are cheap...knowing how to use them is precious...

The foreigner's criminal record is not a consideration in petition approval. This is an issue only at the Consulate. An approved I-130 means he's eligible to APPLY for a visa, not that he's eligible for a visa.

I am petioning for my wife and I the petitioner have a criminal record not my wife.

In addition to that we got our NOA2 yesterday!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! We are eligible to apply and it was approved. Yea!!!!!!!!!!!

In addition to that we got our NOA2 yesterday!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! We are eligible to apply and it was approved. Yea!!!!!!!!!!!

The only kind of criminal record for the US Citizen petitioner that would impact petition approval would be convictions related to the Adam Walsh Act. (sex crimes against children) You can be on parole for murder or even rape and murder of an adult and get a petition approved, but watch out of you got prosecuted for statutory rape of your 16 year old girlfriend when you were 18.
