Timeline

My sister met and Married a man from Morocco. She has two children from a previous relationship. She filed the I-130 on his behalf. Well she got a decision letter on the intent to revoke. Denied. This is the info she has given me.

I filed an i-130 and it was approved almost instantly. he had an interview and then I had to send proof and then he had another interview. The first time was a screw up because the man rejected him due to no photos and stuff but the consular website said to only bring legal documents and nothing more. The man asked him why someone like me would want someone like him. Then when he asked for photos Khalid offered to go get some that were outside and the man said no and rejected him then. So I sent uscis the photos that were requested and everything was fine. This time the man rejected him saying that he didnt know anything aboiut the girls which is a crock because Khalid spends time any time the girls are here with them. He knows the ins and outs of both girls. hes learned how to take care of grace and I stated this in my last package of proof. Basically its the consular officers accusations that our marriage is a sham.

the decision on the intent to revoke The denial letter states that although I presented personal information outlining our feelings for eachother my proof didnt give foresight into future plans on being together like dreams to get a home and things like that. I dont have that proof because all our future plans we have ever made we did vocally. The other major portion of the denial is that Khalid just generally sucked at the interview. Not that its totally his fault but he gets nervous and stammers and stutters. The consular officer called our marriage a sham.

There is an error or two in my letter I got today. First its something silly but it said Khalids last interview date was november 2nd when it was the first, secondly and more importantly it doesnt list the evidence I originally sent including my only copy of my wedding dvd,,,My friend thinks 2 different people reviewed the evidence thus didnt get the full picture

Shy skyps with him everyday and travels to see him about twice a year cause thats all that she can afford to do. The letter had the form Notice of Appeal to the Board of Immigration

Appeals from a Decision of a USCIS Officer

She doesnt know how to go about filling this form out to appeal. Anything else that she should know?

I am happy that bringing my husband from Canada was so much easier.

Tell her to get a good lawyer to send in the papers because if he is a bad interviewer and she is bad at sending evidence then an appeal will be denied also

May 24, 2011 NOA1

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

No electronic media, so they would not have looked at the wedding DVD.

She is going through a very difficult consulate, and it sounds like they were given a chance to submit more info but what they sent was not enough.

- What is their age difference?

- Are they of the same religion?

- Does his family approve?

- How often have they met?

- How often has he met the kids?

- What questions couldn't he answer about the kids?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

She needs to reply to the noir with all the evidence possible, including photos, especially photos with family members on each side if possible & photos showing them in different places at different times.

Any red flags need to be addressed - red flags in Morocco would be things like large age difference, very short time between meeting & marrying. Did she marry the first time she met him?

Thy won't review a DVD.

Do a search on NOIR on visa journey and you will get more info.

Why isn't your sister on here looking for help herself?

They are past the NOIR, it was revoked already. They need help with the appeals. Tell your sister to get a lawyer...and she should be the one on here researching everything she can on this consulate. Good luck
