hi everyone..pls help..i just want to ask...if do we need the atty to fill up the I-864 just my hubby is deploy rigth now and was'nt able to to the papers????is it required that we must fill that form for the petion?cant it be only the paystubs...tax form..letter fr the employer alone as support the papers for the petition?....tnx..God bless....

864 is not used for the K-1.

The I-134 is used for it and you do not do this until before the interview.

AOS was approved in 2 months and 8 days without interview.

Your timeline says you're applying for K-1, which is a fiance visa for people that intend to marry in the U.S. If you are married already to him or you won't be able to marry him in the U.S. because he is deployed, you can't seek a K-1.

If you are applying for a K-1, then yes your fiance needs to sign I-134, not I-864. The attorney cannot sign for him. As an active military member, he needs to reach only 100% of the federal poverty guidelines.

I-864 is necessary for those applying for spousal visas or those who are adjusting status in the U.S. after marrying.
