I posted the same topic in K-3 forum... I'll appreciate more answers from you, MENA, too.

Hello everybody,

I have a couple of questions and I need your help please :help:

Our I-130 was approved on 08-21-2006 (the I-129F was approved in the same day, too, and it was forwarded to Casablanca)

I (the alien) received the « Choice of Agent form » - i sent it back and chose my husband who lives in USA as my agent.

We are following the NVC chart, but we are a bit confused :wacko: … Sometimes, we wonder if we are going in the « right » track or not?!! :blink:

Now we are less than a week to my I-129F interview in Casablanca (October 19th) … If everything goes well with my interview, I’ll travel to USA by December

For my husband’s side, he sent back the AOS Bill payment. He received also the I-184 affidavit of support package and he’ll send it back in the next couple of days!!

What should the next step be? Should my husband continue following the petitioner track as it is explained at the NVC Process Flowchart??

Or should we abandon and wait till my arrival to USA to start the Adjustment of status process?

We need your help because we are a bit confused and we don’t know what we should do???

This is really a matter of your own personal preference really. I am assuming that he hasn't received the bill for the DS-230 yet, correct?

Here is the basic run down. You plan on coming to the US in December, pending approval of the K-3 visa. Now if he proceeds with the CR1 then if all goes according to standard procedure I would expect you to have the interview for the CR1 approximately in January or February. Now if you drop it, and to be honest, I wouldn't do that until after your K-3 interview, then you will have to start again when you get in the US. This process is more foreign to me, so maybe someone else can guide you there.

So here is your choice, fly back for the interview in a month or 2 after you arrive in the US or drop it. We can't say for sure what your best choice is. If it were me, and I was able to fly back, then I would proceed that way. The CR1 visa is just so much better, and if my guess is right, following through will be faster than to start again. On the other hand, if flying back so soon is difficult, then it would be best, not to drop the CR1 now, but rather delay payment of the DS-230 until after your interview (that is, if he receives it before then). If by chance you are placed on AR/AP then you will have to wait anyway, so might as well continue with the CR1 at that point. Again, if you are placed on AR/AP no one can say for sure how long it will take, it really is a ####### shoot.

Correct me if I'm wrong, but if she comes here on the K3, then leaves the country to go back for the CR1 interview, and for some insane reason that visa is denied, she will not be allowed back in the country?

Is that right, or am I confused? I think I would rather restart here then risk not being allowed back without starting all over, especially as funky as Casa gets.

have any vj-ers going through this consulate ever rescheduled their interview? Any idea how long do you think it would take to get another one scheduled?

I think you are at a good stage to consider this:

depending on how quickly your husband returned the ds230 payment, he could be getting that packet anytime now (maybe already has). If he can turn that around quickly (perhaps you have already signed a downloaded one for him?), you really could look for a nvc "case complete" very shortly after. See if you can put off the K-3 interview just a little bit and aggressively turn in your I864 and ds230....you just might be able to get a cr-1 at your deleyed k-3 date. Since they seem to be nicer to the ladies, you could still aim for december travel, too.

it's kinda of dialama for us now :wacko: ... but we prefer at least for the moment to keep our focus on the next thursday interview.

I don't know how long it would take their case, but it took an additional 3 weeks after they received our payment for the DS-230 before they actually recorded it and sent us out the form. Once they got the form it took an additional 4 weeks to review. Once the review was completed they scheduled the interview for 5 weeks later. I think doing it this way is actually a good idea, but not if their goal is to have the visa by December.

As for granting the K-3 and denying the CR1, well it is possible. I have never heard of it happening, but that isn't to say it hasn't. One thing is for sure, they are a lot nicer to the women than they are the men.
