need help affidavit of suport

Hi,its my second post for today,and i need your opinion,

my Fiancee's cosponsor is going to be my sister...

my sister filed taxes last year joint with her husband and include there daughter.so thats house hold of 3.they both make around 28.000 for the year 2011,so its over the poverty federal line,

so now,do they have both to fill out and sign each form i-134?

or just needed from one of them?

am really confused.

my sister made by her self around 17.000 or more in 2011.because she start working the mid of 2011.

and in this time she makes around 40.000 a year.

so do you think if she filled the i-134 by her self would be enough?even if she filled 2011 taxes joint?

You can only have one co-sponsor with the I-134. There is no combining of incomes. If she currently makes $40k individually, then she would qualify for a household of 4, herself, her spouse, her child and your fiancee. It does not matter if she filed taxes jointly. It matters how much she currently earns on her own. She needs to supply her 2011 tax transcript, a letter from her employer stating position and salary plus a few months worth of her most recent pay stubs to prove her current income. She will also need to provide proof of being a USC(copy of birth certificate, naturalization, or bio page from US passport) or LPR(front and back copy of green card).

So how is what going to be? I just gave you all the information I know how to give you. She CURRENTLY makes $40k annually. That is what you have said twice now. That is more than enough for a household of 4, which I said before is: herself, her husband, her child, and the beneficiary. I told you what she needs to provide along with her I-134. What else are you are trying to ask? Is she self-employed or does she have an employer?

The 125% of the poverty level requirement is for CURRENT income and not what she made in the past last year. She still has to provide her 2011 tax transcript, as everyone does(and it is fine that is a joint tax transcript), but her income will be based on what she is earning right now, this year, not last year. She proves that she will make $40k this year with the letter from her employer and recent pay stubs showing how much she receives each pay period.

wow that makes me feel Good.I thought they would judge the income for the past year,I think am ok then,

so w2 tax return is not enough or need tax transcript?

If her income was borderline, I might tell you to choose a different co-sponsor because her past income was low too, but $40k is not borderline for a household of 4, so her current income should work just fine as the co-sponsor. She makes enough to cover a household of up to 6: http://www.uscis.gov/files/form/i-864p.pdf

You can send a complete copy of the tax return, which is all pages: the 1040 plus any schedules and attachments and the W-2s and/or any 1099s she might have. OR, you can get a tax return transcript free from the IRS. You do not have to worry about whether or not the return is complete, or the need to include the W-2s. i do really have more questions if you dont mind answer them,

so on the form i-134 that my sister is going to fill out for my fiancee.there is a question says ( relationship to sponsor) what to put there?sister in-law.but we are not married yet!!!and it might be a red flag!!

Your sister can put brother's fiancee(or sister's fiance, do not know if you are the male or female) for relationship.

No. The I-134 does not need to be notarized.
