Timeline

My fiance and I are both currently in Honduras. We plan to marry in the fall and start the DCF process after. My question is this, he has a tourist visa and, because we want to celebrate with my family, we are planning to go to the US, have a wedding, return to Honduras, have a civil wedding, and then begin the spousal visa process. My question is this, will having a wedding ceremony in the US first mess up anything about our immigration process? We will be returning to Honduras before he overstays his visa.

Well the purpose of the tourist visa is for tourism not to get married. He CANNOT LIE at the port of entry, if the Immigration Officers ask him upon his arrival what he is going to do in the USA and he says "tourism" he is lying and to lie or omit a fact is considered misrepresentation, it's very..damn serious, if he says the true probably they won't allow him to enter.I saw a few people in your situation, they got married in the USA and returned to their home Country and got the CR1 visa, but I saw some cases they didn't allow the foreign alien to enter as well...it's too risky.Good luck.

What if we intend to stay with my family for about 3 months beforehand? Every time he's entered the US before, they've stamped his passport for 6 months. The purpose of the trip is actually to visit and get to know my family, we just intend to celebrate our wedding with them before we return.

Go ahead and get married in the U.S. It will not hurt anything. If anything it will help. Just dont lie to U.S. athorities about anything, but you can do as you mentioned and tell them you two are visiting the family...That's not lying. Goodluck.

5/17/2012 -- I -130 Approved

5/24/2012 -- Submitted Packet 3

6/04/2012 -- Medical

6/18/2012 -- VISA Interview - Approved

6/21/2012 -- Recieved VISA

7/03/2012 -- Fly to the States

Plenty of Americans go to France, Italy, Tahiti, you name it, every year to get married. At the same time, plenty of people come to Vegas, New York, Hawaii etc. to get married. The only visa appropriate for this is tourist visa (K-1 if the plan is to stay). Getting married and intending to stay on tourist visa is illegal, getting married and going back to Honduras to DCF is legal, legitimate and problem-free as far as the CR-1 process goes.

For immigration purposes, wedding = B-1/VWP. Wedding + staying = K-1.
