Hi there!

I hope someone here will be able to help me with that, I am running out of ideas. I just found an employer willing to give me a job in the U.S, but I don't know what visa I should apply to. The job would start within the next 3 weeks, so I cannot wait for October (for H1Bs). Let me tell you my Visa background:

I am from France (might matter)

-I arrived in the U.S under a J1 visa, performed a three months internship

-Right after, I transferred the credits from my french school to a university in NY, I was then under a F1 visa

-At the end of the F1, i started the OPT, found a job, worked for a year, but did not get sponsored.

-I am now back in France for a month, and I found a job in my field of study in NY.

-I should mention two things: A) on my last J1 visa, it's written "two years rule does not apply - CIEE"

B) I am still enrolled in my school in France, they require me to perform another internship in order to graduate. I did not need to graduate to transfer my credits.

That pretty much sums up my situation. Here are the options i can think of:

-H1B, but I believe I would have to wait for October to get the visa

-a New J1, even though it seems to be a job, my manager intends to teach me a lot of things. Problem is I would be paid, and i wonder if that would be an issue. Also, I don t know if I should apply to an internship visa, or a PCT (professional career training). I still don t know the difference.

That's all i can think of. Right now I m about to apply to a J1, but in one hand I read online that I won t get it because of either the salary, or the fact that i ve been there for too long and I m trying to stay too hard. Also the fact that I performed an internship before. But in the other hand, companies working with the CIEE (such as Parenthese in Paris) tell me that since I still have to performed an internship for a french school I am still enrolled in (no matter the previous J1, or the fact that I already graduated from an American university), I WILL get the J1.

I don't know what you guys think, I am running out of time, and ideas.

I know, but I would get comments that were not answering to my very simple and clear questions. For example, I understand that usually the lawyer is in charge of such matter, but this isn't the purpose of my question. I want to know what my options are, and also if the salary would be an issue for an internship. There's also the fact that I already performed internships before.

The reason that you didn't like the commets aren't enough reason to open the new thread.

I don't know about internship, but when it comes to visa H1B, it's all in your future company hands.

They are doing the whole process. They have to prove that they don't have such qualified employee in the US and that's why they need you. The whole process is expensive and requires a lot of work from the company, so that's why the visas are hard to get. But it's not impossible.

That's closer from what I was expecting. Thx Asia

Besides, if I apply to a H1B, I won't be able to work before October 1st I believe.

What about the J1? Would the salary be an issue? And the fact that I already performed an internship in the US?
