Do you need to get 2 medicals for AOS?

Hi everyone,

I moved to the US on a k1 visa in October. I had to have a medical done in June 2011 in order to get the k1 visa and I thought that was the only medical I had to do. I applied for adjustment of status in October and just got a notice saying that they reviewed my file but need me to get another medical done (I 693) because they don't have forms DS 2053, DS3024 or DS 3026. Why would they need me to get ANOTHER medical done when I've had one within the past year? Is this a mistake?

You are only required to have one medical exam and it is valid for one year. One possibility is the medical paperwork was lost or wasn't transfered from the embassy to the US. Did you get a copy of the DS-3025 from the CS who did the exam? Did you include it in your filing for AOS?

Don't let what you cannot do interfere with what you can do.

After reading some other posts, I realize that this is a common RFE. It appears as though my medical record was collected at the point of entry and probably wasn't connected to my i-485 application even though it says you don't have to resend a new medical. My question is, how do you get USCIS to find your medical record collected at the POE? My RFE states that they have my vaccination record so I don't need to submit that part. Alternatively, if I could get my civil surgeon from Toronto, Canada to send a copy of the medical I got done last year, could I just mail that in instead? It's won't be an I693 but it would be all the other forms. Thanks again!

They will probably want the I-693. I would suggest to get the CS from Toronto to send the copy and have a local CS transfer the information to a I-693. You wont need the medical again and it should be inexpensive.

Don't let what you cannot do interfere with what you can do.

I'm sorry but I really feel the need to vent. I have had difficulty due to immigration's incompetence (especially the Montreal Consulate) every step of the way through the immigration process. It seems like the lost medical has been a common issue for AOS applicants for at least 6 years. How has this not been dealt with? How is immigration so negligent? I am starting to understand, with the expense, frustration, and stupidity of the immigration process, why there are so many illegal immigrants in this country. I can't wait for my husband to get out of the military so we can move back to Canada.

Unfortunately there seems to be no shortage of human error with USCIS. It only takes one person out of the many who touched your file to screw things up... I feel for you, I can only imagine how frustrated you must be!

Unfortunately, you may not have much luck getting a copy of the medical from Toronto, but its worth a try. I remember a member who tried this in recent years, and Toronto would not send the information out (maybe it was colleens?) If you can't get this, I think your onmly other option would be to get a new medical done. There really isn't a process to follow to have USCIS locate the information, unfortunately.

Agree with Hugglebuggles - easier for you to just go get a new medical done in your area. you'll spend more time 'trying' to get the old one which will by then no longer be valid anyway. It will just hold up your AOS which isn;t the most desireable either.

I feel your pain. The exact thing happened to me. They lost my medical, and I had to have another one done AND I had to pay $280 for it. It's complete nonsense. The one part of the whole thing that I literally had no control over them receiving, they screwed up and it cost me. I called USCIS to complain and got a "Well, that's your problem" response.

Thanks for the support! I seriously really need it right now as I am feeling incredibly discouraged. In addition to this situation my visa application was lost and I was unable to reschedule my visa interview just 5 days after having emergency surgery for a burst appendix. I did the 10 hour to drive and suffered every bump along the way! I think I will call to have a new medical done but I am appalled that this has happened to so many people and that USCIS takes absolutely no responsibility for their mistakes. I have contact the Ombudsman. I know he may not be able to help me since I have a time limit but I perhaps he can do something to prevent this from happening over and over again to other people. If this has happened to you too please contact the Ombudsman. If he gets enough complaints maybe they can fix it! Here is the link...

Venting is pretty much justified. Unfortunately most of members here had to deal with USCIS incompetence at some point in their journey.

But IMO, the easiest and fastest thing to do now would be getting a new medical here in US.

Easiest and fastest, yes, but that doesn't make it sting any less. Having to pay TWICE for something is irritating, especially when you've done everything you were required to do. You didn't make the mistake, yet it comes out of your pocket. Very frustrating.
