 'it's going to be pivotal.'

man, i hope that was a copy & paste from huffington. if not we need to send a nutter van up to russian river soon.

c&p from the article....

However, when this frightened girl gets on the stand, in front of the jury, it is all but over for Zimmerman. The smartest thing the defense could do, is not cross examine her, if any of the jury members start emoting with her.

Yeah, I think the prosecution has quite a few things up their sleeves and they would be wise to hold their cards close. Is there any way to recover those conversations on the cell phones? What I mean is, the only thing they can retrieve in the way of evidence for the cell phone calls are time/date/duration and so forth. The only thing we'll hear then regarding the calls between her and Trayvon are her testimony I suppose.

The new forensic facts challenge the second-degree murder charge, which, to stick, requires a jury to be convinced beyond a reasonable doubt that Zimmerman acted with malicious recklessness in causing Trayvon’s death

No it doesn't. It only has to show that Zimmerman acted with a disregard for human life. The bullet through the heart is enough to show that. The second degree murder charge by itself is a slam dunk. All the elements of a prima facie case are there, by Zimmerman's own admissions. Zimmerman has to either win the immunity hearing for stand your ground (unlikely), or failing that, prove self-defense. The standard of proof for both those affirmative defenses is "preponderance of the evidence", the same as a plaintiff in a civil action, except that the jury must come to a unanimous decision in the end.

oh they'll listen. but, it won't hold any weight. can you give an example of a teenage GF's testimony based on a phone conversation that nailed a conviction?

That's not what Bill meant by pivotal and you know it. The prosecution's job is to recreate the sequence of events that led up to the shooting on the night Martin was killed. The phone records, along with the gf's testimony will be pivotal into establishing some cohesive timeline, along with Zimmerman's 911 call, location of his parked vehicle and where Martin's body was found by police. Based on those pieces of corroborating evidence, it is clear that Zimmerman was in pursuit of Martin. Zimmerman, on the other hand, claims he was walking back to his vehicle when he was jumped by Martin.

Another item I find rather compelling is that Trayvon's girlfriend has said from the beginning that she hears Trayvon ask Zimmerman why are you following me?? ..followed by a thud. Now...you don't normally drop your phone unless someone shoves you or knocks it out of your hand. How is this possible if Trayvon was the aggressor and acted first? :bonk:

Better not tell Zimmerman that, he might shoot ya.

"I want to take this opportunity to mention how thankful I am for an Obama re-election. The choice was clear. We cannot live in a country that treats homosexuals and women as second class citizens. Homosexuals deserve all of the rights and benefits of marriage that heterosexuals receive. Women deserve to be treated with respect and their salaries should not depend on their gender, but their quality of work. I am also thankful that the great, progressive state of California once again voted for the correct President. America is moving forward, and the direction is a positive one."

Does anyone here have an idea of how Zimmerman managed to draw his gun while being straddled by Martin? In other words, where did Zimmerman physically holster his gun and how was able to draw it with Martin on top of him? Zimmerman is listed as 2" shorter, but looks to have weighed closed to 200lbs at the time, or at least having a considerable weight advantage over Martin.

Some goof on a gun range? Are you referring to his police academy trainers? I'm pretty sure there's gun training involved somewhere right? At least that's what they show in the movies.

Well, when the lead investigator's sworn statement says that this shooting was instigated by Zimmerman's actions that night, his lawyer will have his work cut out for him in convincing the jurors that in spite of his actions, he reasonably felt his life was in danger by a scrawny, unarmed teenager, holding a glass bottle and trying to pummel him to death without using that bottle. A weak argument at best.

Zimmerman was strong enough to pick up a women and throw her far enough that she twisted her ankle when she landed, when he had a short-lived career as a bouncer. You would think he could have handled a punk like Martin no problem.
