Witness testimony also showed that Zimmerman was right to use his handgun. Also I see that the medical reports show Zimmerman had the injuries he claimed. Everything is backing what Zimmerman has claimed. Just release the guy already and apologize for being azzholes.

Picking a fight with a minor half your size and then murdering him before the cops arrive deserves a free pass along with an apology for "being azzholes?" wacko.gif

This story should have never made the news. Zimmerman should have been arrested immediately and sentenced to life w/o parole.

Bizarre that in your world neighborhood scuffles with teens is such a life threatening event that murder is the only appropriate action to take if you want to come out from the teenage wrestling match alive. wacko.gif

I think people really have to let the courts figure it out. There's a lot of physical evidence and witnesses in this case. There's people trying to pretend Trayvon Martin was just an innocent little school boy, the guy was 6 feet and 160 lbs. And others trying to pretend George Zimmerman is this perfect person just trying to protect his community. The truth is no doubt somewhere in between. Monday morning quarterbacking makes it easy to say Zimmerman should have stayed away and waited for the cops and Trayvon would be alive. Trayvon would also still be alive if he hadn't been suspended from school for bringing pot there and being sent to his father's home. Its a good lesson for neighborhood watch groups not to engage, but wait for the police. One thing is evident, with evidence of physical damage to Zimmerman and multiple witnesses, the prosecution is going to have to prove Zimmerman attacked Trayvon and thats why he ended up under Trayvon getting beat up when the shot occurred.

...the testimony of Martin's girlfriend will be pivotal.

The girl, whose name was redacted from the released audio files, spoke with assistant state attorney Bernie De la Rionda on April 2. During the 22-minute interview, she said in a shaking voice that she had been talking with Martin since before he entered a 7-Eleven store to purchase his now famous iced tea and Skittles.

The cell connection was bad, and the couple were repeatedly disconnected. But at one point, Martin told her he noticed a white man sitting in a car, watching him.

"He was telling me, like, that man watching him, he going to start walking and then the phone hung up and I called him back again," the girl said. "And I said, `What you doing? And he said he walking and he said this man still following him."

It was drizzling, and the girl said Martin told her he was putting up his hood.

"I told him go to his dad's house," she said.

Martin told her that he was going to run. She could hear the wind blowing in the phone's speaker.

"He was breathing hard," she said. "(his) voice kinda changed. I know he was scared. (his) voice was getting kinda low."

Suddenly, she heard Martin say, "Why you following me for?"

The girl said she could hear another voice, one she described as deep and belonging to an "old man."

"The old man say, `What you doing around here?'"

She asked Martin repeatedly what was going on, but he didn't respond. She said she heard someone say, "Get off," though she thought it was her boyfriend.

She heard rustling, then nothing. No screaming, no gunshot.

The evidence dump included another interview with the girl, but the audio quality is so poor as to make it almost unintelligible. One thing that did come through: A detective mentioned that the girlfriend called Martin at 7:12 p.m.

When police arrived at the scene at 7:17 p.m., Martin was already shot and on the ground.

"She's the only person, for sure, that is a witness who knows what he (Martin) felt and sounded like in those moments," Lave says of the girlfriend. "All those things can play a role in the outcome of the case."

Because most people talk this way, that doesn't make them anything but rude, or maybe just politically incorrect.

Actually, in a workplace where people are supposed to be "professional" this doesn't normally happen. It's called harrassment. And it's against most company policies and also against the law. It's called workplace harrassment if it's severe or pervasive enough. Apparently, Zimmerman's case must have been determined to be severe enough that they fired him.

Even though he wasn't in fact a cop, would you want someone with this sort of mindset "protecting" your city?

lol...that's what I was thinking. Her testimony isn't going to mean much.

Spouses are called as witnesses all the time. Can you give an example of a case where a judge refused to listen to testimony from a witness because they had a relationship with the defendant?

It was manslaughter.

  • Diminished capacity is a defense which serves to negate the mental state of "malice". If a jurisdiction recognizes that a person can kill without justification, but also without any evil intent, for example due to a mental defect or mental illness, that jurisdiction is free to define the crime as something less than murder. This partial defense is only available in some US jurisdictions and not others; whereas the complete defense of insanity is available throughout the US, but rarely used because it is more difficult to show.

oh they'll listen. but, it won't hold any weight. can you give an example of a teenage GF's testimony based on a phone conversation that nailed a conviction? :lol:
