Montreal June 2012 Interviews!

Timeline

I just had my medical in Toronto on Tuesday .. what an easy process!! I was there at 6:55 am and a lady let me up right away .. I was the first one there and she right away took me into her office, took my passport, passport pics, immunization records, letter from the consulate and payment. You sign a few things and then she sent me into the room. A nurse then came in right away, weighed me, measured my height, took my heart rate. The doc then came in to go over my immunization records and do a quick check up.

AT this time it was 7:35 am, I was sent back to the waiting room where alot of people were waiting. Waited to be called for my blood work (10 mins) I was then sent to the xray place (around the corner)

I was out of there by just after 8 am.

Go early!!!!! That is the best advice I can give you and have all your documents ready!

Had my interview today and got DENIED!!!

They want more proof of Domicile from my sponsor/wife. She is a dual citizen and holds US and Canadian citizenship.

We knew domicile was going to be a problem, but thought we had it covered.

We had a letter from the owner of a property that we are going to rent once we POE. and also brought our documents showing our house here is sold and we have to be out by the end of July, Proof of US bank accounts, a letter from the real estate agent we are working with who is 1500 miles away in the state we want to move to. We actually flew out to meet her and spent the week with looking at property to build/buy just 3 days before our interview. Proof of applications for State licenses so my USC sponsor can work in her field when we get there....But they weren't buying any of it in Montreal. They want her to send in further documentation to prove she is actually living in the US (which we aren't yet). I guess even though you can prove you are "re-establishing domicile" that is just not good enough for them. Back to the drawing board.

Wow, that is crazy...that seems like more than enough evidence!

Oh wow.......... I'm so sorry!! Hopefully, you'll be able to get the needed documentation soon and it all solved quickly.

After reading recent posts regarding how tough Montreal is on domicile, we're making sure my daughter's fiance gives her a few more pieces of documentation proving his domicile. He's never lived anywhere else, so I'm confident we'll have enough.

This is starting to get more stressful. My daughter's interview is 8am Tues June 26. Anyone else interviewing then??

I'll be waiting outside the Consulate for her, most likely on pins and needles the whole time :unsure:

I was feeling more than confident that we had enough, so I wasn't overly nervous or worried about the whole process. We were not rude or disrespectful to them in any way (even after she told us they were putting a hold on it) Thanks to Saylin and all the other Vjers here we came in feeling very well equipped..too bad they still denied it.

I think the biggest issue they had with regard to our domicile is that my sponsor/wife left the US at 13 months of age as a baby(her parents are Canadian and were living/working in the US back in the 70's) and has never had residence since them. (until the pending residence we have established now) It has been more difficult for us because we have no immediate family in the US (only 2nd cousins). Since she has not yet actually been living/working there (we wanted to stay here until the house is sold and go as a family) the c.o. seemed intent on the fact that we have more proof. It almost seems like the "proof of reestablishing domicile" is a moot point....They would be better off saying that you MUST have domicile in lieu of "re-establishing".

I think what it all comes down to is money...If we could afford to support 2 homes then hell yeah she could go over and live there for weeks/months/years before me, but we really can't afford to float two homes at the same time while waiting for a visa. I guess it would have been better to have closed the deal on our home and been out of the housing/living temporarily in our elderly parents basement. Then went over and bought/rented a place and she could have started living there and then we could have went to the interview. Then what would they have done to deny us??

It was totally ridiculous at the interview they ask when we were married (19yrs ago), how long we knew each other before marriage (5years), where we met (high school sweet hearts)....I mean honestly we are standing there with our 2 kids (7 and 11), been together almost 25 years....This is obviously not for citizenship. We had no skeletons in our closets (no divorces or other family issues) no jail or court issues....Somehow the c.o. girl thought that the kids were mine but not ours???? I have no idea how she got that idea so we had to clarify that yes these are our children...made by the both of us and no one else??? WTH this whole thing is a joke. This will get wrapped up shortly one way or another.

The elevator should not be a problem. My wife and I were laughing to ourselves, and I knew there were no other VJ'ers on with us because we were the only ones who got on and went to the back left and faced the back of the elevator. ppl were giving us weird looks since we were staring at the back of it...until the doors opened and they all had to turn around. It was great because I walked right up and the girl handed me ticked number C1

(until the pending residence we have established now) It has been more difficult for us because we have no immediate family in the US (only 2nd cousins).

I think the issue with the CO was, she moved as a child, her parents are Canadian Citizens, not US citizens, she has zero immediate family in the US, and they left over 3 decades ago. There is no domicile to re-establish.

With that being said, one would think all the evidence you took with you would suffice, you are obviously trying to establish yourselves.

Although we are probably on their radar, we may try and "visit" and then see what happens.

Ya, I just think that the USC needs to at least have a job lined up showing that they are going to start work as soon as the visa is approved. Otherwise they could have a home, but immigration thinks a home could be used as a vacation home/rental property, etc..

My wife and I decided that she should accept a job and move before our I-130 is approved. Then there can be no mistake about her domicile. It just so happened that she got a job in her specialty--Kindergarten teacher. We were lucky in that sense.

I don't know if you are able to do this (if you have children, it would be very difficult to be separate while you wait for the visa to go through).

So the only things I could even think of that could help your case is for her to move to the US first, or to find a job and get a letter of intent of some sort from her employer (ex. a job offer letter which while it does not help with the amount on the affidavit of support, does help prove domicile). It sucks that people do not seem to understand the traditional marriage (ex. remaining together until the move is possible). They just assume that you're okay with living apart apparently.

Anyways, I hope this case gets resolved soon. It actually makes me upset to hear about it.

And on top of that I got an email tonight saying that DHL has picked up my passport, hopefully have it in a couple days!!! :dance:
