Hello,

My name is Krasimir. Im new in here. I can see there is hundreds of topics. I dont want to bother you much, but i have couple simple questions.

In next few sentences i will try to explain you my case and how we can help me to solve it in the best and fastest way for me.

My mom is currently married for US citizen. She got her 10yrs green card not long time ago. she is about to be eligible to apply for a passport.

I know this process will take at least 3-4 months for the interview and than to receive it and than for me to apply for green card.

My question is, is there any other form which i can use or apply right now for documents or i have to wait for her to get her passport?

How long it takes from the applying to the interview, how long will take to receive it and than how long will take for me?

This is what im interested in. I hope you have some answers for me :)

I really really appreciate any type of help and guidance for the topic above.

Thank you in advance !!

Krasi

hi,

how old are you and are you single or married? that makes a big difference, if you are unmarried, she could have filed for you as soon as she became a LPR,

for her to receive a passport she has to first file citizenship n-400 form take the civil test take the oath ceremory, she becomes a united states naturalization citizen, she applys for the us passport 110.00 fee takes about three weeks.she is a LPR now she can file 1-130 for you.if your under 21 you can be here within one year, if your over 21 then you have a long wait like 6 plus years f2b when she becomes a citizen she can upgrade your petition to f1 you may save a year.some counties the wait is longer.if you get married it's even a longer wait, file the 1-130 asap.

I presume by your title that you are over 21. In which case is does not matter if you are single or married.

You cannot have a K-2. K-2s must be issued within ONE YEAR of the K-1, if there is a K-1 and obviously that is not the case.

The other alternative for children is the CR-2 but that can only be used IF you are under 21 AND your mother married the US citizen before you turned 18.

Otherwise your mother can petition you after she becomes a citizen (takes the oath and receives a certificate which can be 4-6 months after she applies) Once approved you will wait for a visa number. Since you are over 2 you lose the benefit of an immediate visa number. Wait times vary by country but figure 4-10 years. You can check it out on the DoS website to get a more accurate figure but keep in mind that only tells you what the situation is today, it can chnage one way or the other before you are eligible

Hello,

Thank you to all of you for answering my questions.

I`m over 21, single. We already file I-130 back in 2010 and i saw there is a BIG time waiting.

I had the impression that if she becomes a citizen she can apply for me and i can receive a green card withing months, like a child of two citizens?

Ive read the instructions for I485 and I assume that we can apply fir 485 since she is a citizen?

btw im in USA under F1 status right now.

I hope i can find a faster decision!

Thank you one more time for your time and advices.

nope, for children over 21 it is never quick, now there is a over 7 years of waiting, currently they are working with petitions filed in 2005.

My USC mother filed for me and I also was a child over 21, divorced, so I was considered as single. I had to wait 5 1/2 years for the interview.

so, unless you can maintain F1 status all these years, you cannot overstay one day and become illegal, you will have your interview at your country of origin.

to be able to adjust status, your priority date has to be current.

Play diversity visa in October-November this year? One caveat is that you must be in status to be able to AOS when your number comes up (if selected in visa lottery).
