I am a US citizen and what are procedures to bring my 26 year old married step son to US. I married his mother(permanent resident)when he was 20 years old.

hi,

unfortunatly you cannot petition for him, the marriage had to be before he was 18. you married his mother when he was 20. when she becomes a USC, she can file for him.

There is no path more married children of LPR's only USC's If she has had a green card for 8 years she can apply now for citizenship then apply for her son , otherwise it is 3 years to citizenship based on marriage to you before she could apply

LPR can file for spouses and children and UNMARRIED adult children

USC can file for the above plus married adult children plus siblings plus parents

The son isn't your step because of his age when you married so you can't do anything

As soon as your wife becomes a USC, she can file the petition for him. Unfortunately, even though you are his stepdad, you aren't considered his stepdad for immigration purposes. I know it's stupid, but the people in our government aren't all that smart.

The category for married children of USC's is F3, which is taking about 11 years or so. As an LPR, your wife can't petition for married children so she should become a USC as soon as she can to petition her son. The good thing is that at least he would be able to bring his wife and children as part of the same petition.

A long time, right now both F1 and F2B PD's are stuck in 1994. That's looking like a 20 year wait. I would have mom petition you, even if she's an LPR, because F2B tends to move a little faster than F1. If she's a USC you would be F1.

Uts been a long time but how long would it take for my I-130 to get approved if my mom married my stepdad when I was 16 Im now 21 thank u
