My I-94 will expire the day after tomorrow!!

My I-94 will expire the day after tomorrow,I flew out to US on the 28th of March and he proposed to me on the 31st of March. We don't want to be separated again. I am on a tourist visa which expire soon. We have been together for 2 years, this is the 3rd time i flew out to US. Should me and my fiancé get married before my visa expires? Help!

Timeline

You have three options, choose the one that suits your life:

- get married immediately, apply for Adjustment of Status. Cannot leave the US or work for several months.

- Get married immediately, then leave, have new husband petition for CR-1 spousal visa. Takes 8-10 months, you can visit during the process, get a greencard immediately upon entry and can work, travel etc.

- Leave, have fiance petition for K1 fiance visa. Have 6-8 months to plan wedding, visit during process.

Personally, I would likely choose the third option so as to have more time to think about everything and plan, but everyone is different.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

we would like to get married right away but there is the 60-90 days thing.

There is no 60-90 day thing. The important thing is to show you have a bonafide relationship (visits, photos, emails, phone bills etc- co-mingling of resources once married, such as add eachother to bank accounts).

I agree with penguin that 3 sounds very good, but since you said you don't want to be separated and you want to get married right away. Maybe you should chose option 1, as that is the only option that allows for both. Good Luck!

March 1, 2016 - Biometrics Appt

March 29, 2016 - In Line for interview

April 1, 2016 - Interview Scheduled

April 4, 2016 - Interview letter received in the mail

May 10, 2016 - Interview Day! (Approved)

June 8, 2016 - Oath Ceremony
