Hello. I am an American that is now living with my fiancee until I can get her to the US. I have been living here in Mexico for a little over a month now. I was told if we got married here, it would make things quicker. So far the Mexican government needs an apostle for my birth certificate for us to get married. I am in the process of getting the needed documents. Will it be quicker to get a K-1 or get married here and get my FM2 then Direct Consular File for a K-3?

to do direct consular filing you need to have been a resident in Mexico for at least one year. And the way you file depends on what you want. The k-1 gets her to the US faster, but then you have to get married withing 90 days of her arrival in the US and files all the papers for the marriage and affidavit of support after. she will not be a resident until all that is complete. with the cr1 spouse petition. it takes a few months longer, but when she enters the US she will be a conditional resident immediately. with both petitions the conditional resident card conditions need to be lifted after the 2 year mark of residency in the US.

Getting married quickly is not an issue. I want us to get to the US quickly, before I run out of money and need to return alone. I budgeted for 12 months, but the cost of a temporary life here is more then expected. I also have my 17 year old boy living in my US home, which bring thoughts of mischievous behavior.

Direct Consular File for a K-3 - no such thing.

DCF for a CR-1, is do-able.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

DCF is the fastest way to get her to the US. Marry her now, so that you can establish your relationship. K-1 will take six to eight months to bring her to the US, and cost more money. If you don't meet the requirement for DCF, then do the IR-1 route. Processing times for K-1 and IR-1 are almost the same these days.
