Hi,

Just realized the following:

Sent my N400 late Jan, FP in Mid-Feb, currently waiting on Appt in NY.

Issue:

My GC expires in early July 2012, based on the timelines here and turnaround time in NY (5.9 months) it looks like my process wont complete before early July.

So there is the potential that during my Oath my GC will be expired, has this happened to anyone? Do I really need to submit a renewal and $450 USD for what is possibly a couple of months? There is no garantee that the new card would even be ready since the estimate for renewal of GC is "less than 6 months".

Thanks in advance,

CF

I think you should be fine. Officially, USCIS requires that at the time of your N400 application that your GC has at least 6 months validity left. You seem to be a little bit short of that; i.e, I think you had a little bit over 5 months left when you applied. However, from what I have seen from another tracker is that an applicant was fine even though he had an expired GC. As far as I recall, his GC was in fact expired during the interview and he did not face any problem. But then of course, every case, every office, and every officer is different. You might want to call USCIS and ask. Indicate that your GC will be most likely valid during the interview but that it might expire by the oath. Let's see what their feedback is? Most likely you should be fine. Please report back.

I had the same problem. I made an info pass appointment, I selected the option that it was not related to my N-400 application. I explained to the officer that I had to travel and they gave me a one year GC extension (rubber stamp in my passport). FREE!

Yeah if your GC is expiring before you oath, just make an InfoPass and have them stamp an I-551 for another year of extension.

BTW just FYI I filed my ROC last June and it's still pending, got my N-400 bio done last month though... we'll see how interesting this is going to turn out.

Is this your ten or 2 year greencard? If ten year, no problem. If 2 year then yes, you eneed to file ROC and pay the fees.
