So after she gets her Gc how many months in a given year does she intend residing in the US, how many months in a given year does she intend visiting Russia?

She anticipates that she'll be making two 3-month trips to Russia and the rest of the year here in the US -- 6 months in the US, 6 months in Russia for a given year.

I would have thought she could get away with that.

After speaking with an immigration lawyer, he suggests:

  • We start the GC paperwork and submit for an advance parole so that she can head back to Russia on 7/5/2012 for 3 months and then return back to the US.
  • Make sure that she gets her biometrics appointment done before heading back to Russia.
  • Have the travel documents (I-131) mailed to her US address. She may head back on 7/5/2012 and have the travel documents mailed to Russia if they have arrived before she left the US. Use this document to travel back for the interview.
  • After she gets her GC, apply for 2 year reentry permit with the I-131 to preserve her status. With this preservation, she can travel back and forth; however, this does not preserve the continuous residency requirement for naturalization unless her trips are under 6 months.
  • My MIL will need to reapply for a 2 year reentry permit with the I-131 if she needs to, with a maximum of 2 applications (4 years). I remember the lawyer informed us on a maximum; wife has the notes with the exact maximum.
  • My MIL should file taxes and open a financial account while residing abroad to show commitment to the US.
  • For naturalization, she must meet the continuous residency and physical presence requirements.

Can anyone give some insights on these notes if they have experienced or is in a similar situation, please? Thank you.
