Ok. So I need some advice. I am in a very difficult situation regarding a K-1 visa. Unfortunately once I got here in the US my fiancee decided not to marry me. Yes before the 3 months was up she changed her mind... I cannot work legally so I have no money to go home. With no job it is hard to come up with 1200$. I would like to keep everything as legal as possible because I have a child in this country and want to be with her permanently one day , but I am already out of status by two months.

I have heard before you cannot change a K1 visa to ANYTHING! Even a K3 if it is another person. But what am I suppose to do. I am here with nothing! Barely eating!

Anyone have any advice? I am desperate. Cannot even afford lawyer..

This is going to be moved to effects of migration soon.

Where did you migrate from? Popular responses have been to contact your countries embassy. Additionally I think you're right in that you cannot convert from a K1 unless you married the petitioner. Had you did AOS then it might be different.

sorry to hear that this has happened to you. Surely your ex-fiancee has the decency to GIVE you the money to return home and get yourself settled back into life in your home country. You gave up a lot to get to her, I would ask for assistance in getting back home and GO NOW! So you don't get too long a ban when you want to return.

The K-1 Visa is a Marridge Visa ONLY. The Overstay is not Legal. The Petitioner should have sent you back knowing these consequences will occur later. You need to get ahold of USCIS and/or your Petitioner to get you back home before its to late. That way, departure is voluntary. The Petition is VOID

Go to the nearest embassy your country has in the US, tell them your situation and see if they can help you in getting back home.
