Fill for AOS with my new name or my maiden?

Hi!! I came to the US almost 3 weeks ago with a k1 visa. My fiance and I are getting married next thursday and we already start gathering all the information a paperwork we need to my adjustment of status. My fiance and I decided to change my name, and take my fiance's last name.

Our question is...in our forms, do I have to fill them with my new name or my maiden name?

Since your I-94 hasn't expired then you can go and apply for it now. Then once you are married you can have it changed to your married name, but you will need to wait until you have your EAD before you can change it since your I-94 will be almost expired by then and they won't let you change it if you have less than 2 weeks on you I-94.

You can go before and get it in your maiden name. File for AOS using your married name, and then when you get your EAD/AP, take that card and your marriage certificate back to the SSA and have them change it to your married name.

Make sure you put your maiden name under other names used on the form.

I would advise against this, it will only allow for mistakes to be made by USCIS. Your maiden name and married name will all be on the proper forms.

Can I go before or after we get married?

If you have a job lined up and plan on working immediately, then you can go now and get one in your maiden name. If not, I would wait until after you're married and you get your greencard, there's no rush for a SSN other than employment. There's no need to do it twice, just to change names.

Why would you advise against filling out the forms properly? Previous names used include maiden names or names used in previous marriages. There's no reason not to include it.

This is incorrect. There are plenty of advantages to having a social security number. You cannot get ANYTHING without one. Bank accounts, driver's license, etc. It's very important in establishing a life here.

You are correct. I misread the initial post, I thought the poster said to write her maiden name under her marriage name on all of the forms. My apology.

This is incorrect. There are plenty of advantages to having a social security number. You cannot get ANYTHING without one. Bank accounts, driver's license, etc. It's very important in establishing a life here.

A SSN is by no means neccessary for her greencard, neither is a bank account or a drivers license. My wife never had either of these until after she got her greencard. Why go through the hassle of getting one in her maiden name and then having to go back and do it all over again, if she doesn't have to? If she wants to, that's fine, but I was merely pointing out that she will have to do it twice in a very short time period and that could be uneccessary if she's not planning on working immediately. USCIS is not looking for the greencard applicant to "establish a life here", they are looking for proof of relationship/marriage. Granted these can be one in the same at times, but having a SSN does absolutely nothing to show proof of a bonafied marriage.

You must have misread my post. Nowhere did I state the SSN is necessary for a greencard or for any immigration purposes. I also did not state it showed proof of a bonafide marriage. Not sure where you got this.

Your post made it seem like it had no other benefits other than work, and I simply said that's incorrect. It has plenty of benefits for someone new to the United States. There's not much you can do without one. It's personal preference as to WHEN they get one, but generally, the sooner the better if they want to start being added to accounts, or opening new ones, or getting identification or licenses.
