Good morning I am enquiring for a friend. My friend is marrying her fiance he has been here over two years on a work visa but it as expired for a year. she wants to know what paperwork to file after she get married?

I usually assume when someone says "I have a friend who..." that they are really talking about themselves. But, maybe I'm too cynical. :)

5/16/2012 - Package delivered to Chicago Lockbox at 1:33pm

5/21/2012 - Email/text notifications received at 4:50 p.m.

5/26/2012 - NOA hard copies received for I-130, I-485 and I-765

6/19/2012 - Biometrics completed.

7/02/2012 - Text/email/hard copy notification of interview.

7/30/2012 - EAD card production ordered.

8/02/2012 - Interview @ 2:00

8/02/2012 - Email notification of GC production at 5:30pm

8/07/2012 - Second GC production email

8/07/2012 - EAD received.

8/08/2012 - GC mailed.

8/09/2012 - Welcome letter and I-130 approval letter received.

8/10/2012 - Green card received. :)

He is probably on an H2B visa, he needs to file before it expires, so he will not be out of status. The most important part is they do need to be married.

LIFE'SJOURNEY his visa is already expired over a year now and he's out of status.

What makes you guess this one out of all of them? The only clue is the visa was only good for one year.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

LIFE'SJOURNEY his visa is already expired over a year now and he's out of status.

If they are married, then they need to file the 130 and AOS pkg, the overstay will be forgiven if he is married to a USC.

What makes you guess this one out of all of them? The only clue is the visa was only good for one year.

Because H2b visa's are only good for a max of one year, and I am guessing her friend is another Jamaican. Most JA's are here on H2b visas, a H1B visa expiration isn't usually a one year visa.

Sometimes.

The only other reason would be if he has committed a crime, and that would be another story in itself. But, they wouldn't be asking for AOS if they felt his chance of getting it was slim.

What about if he had a C/D visa.

For example.
