Hi all;

ok, situation is this:

July 2006- I flew to Pakistan,married my husband

July 2007- returned to USA to care for my elderly mother

September 2009- returned to Pakistan...

August 2011- finally filed for I-130 (9 months ago and STILL WAITING!!!)

Spouse Petitioner (me)- disabled and not working- no tax return,can not meet the poverty levels of the US govt.

Joint sponsor- my best friend in PA (who barely meets the poverty limits herself)

husband applicant - owns an internet network,but does not earn enough to self sponsor...

USCIS website says average wait is 5 months- but we've waited for 9 months already!!! and this is only Phase 1 of the process, after (if we EVER) recieve the receipt for the I130, I still need tofile the I 129!

questions:

1. what the hell is taking so long?

2. will I be RMI'd?

3. whenever I can finally move forward with this will I have to wait just as long for the I-129???

4. Will it be a long wait for the interview?

5. Will our age difference be a big issue? (11 years different, I am older) plus, I flew to Pakistan on 26 July 2006 and we married right away on 30 July 2006. His family is grerat to me and my mother and children from a past marriage accept my husband... our famililies have no problems with our age and nationality differences, nor do our friends.

I am a US Army vet with a non service related disability. But seems the govt gives 0 value or importance to military veterans OR disabled citizens! :(

Are we within the typical wait time? When should I start freaking out and calling people?lol I need to get back home to take care of my mother and be in AC again !!! lol 3 years I've been living here because it's the only way to be together :(

You need to Call USCIS talk to a tier 2 operator ASAP and ask to put in a service request OR you can contact your congressman right away and get them on it. It has taken a little longer lately but at this point you need to see movement.

Once your case is approved it will move to NVC and take a few weeks if you go by the short cut for NVC.. then it could be another couple of weeks before knowing when the interview is and is usually scheduled a month out or more

Our NVC took us 6 weeks total and then another month before the interview

As far as the k3 goes.. You should be filing IR1 for his 10 yr green card since you have been married since 2006 not a k3

Islamabad is very strict with poverty guidelines..if you don't think your current co sponsor earns enough then you need to find another co sponsor who can exceed the guidelines

Age differences are a red flag but aren't reason for denial just reason to look at the case closer

Thanks for the reply...I kinda figured that something is going on and I should call..my bf and joint sponsor called last week and said she got an automated machine and it said our case is with a worker now...and I'm not exactly sure where to call to speak to someone with a heart beat lol

I actually DID put on his I-130 that I am filing it for the IR-1 (another 1 year wait I imagine ugh!) As far as another sponsor goes- I honestly have no one at all to ask! My bf says she is still within the limits so it SHOULD be approved, inshaallah! My main concern is that I've lived in PK for 3 years and as a disabled citizen, I'm afraid THAT will make problems... What do you mean when you say 'if you go by the short cut for NVC'?

This will save some time from mailing the ds3032 etc you can do everything online including the payments the only thing you have to mail and I would mail it overnight certified with sign upon receipt is the i864 package and the ds230 package

You can call USCIS and ask for a tier 2 operator if you need to speak with someone... you may have a few more months wait before the interview

As for you, you need to show US domicile... Im not so familiar with that so I can't give you correct information on it... good luck

your advice worked- I called and talked to some chic and she took the info blah blah blah and said my case is out of normal processing times and she's sending that to the CA service center and she said within 15 days I should receive the NOA1 (please God!!!) Then I can finally (God willing!!) move on to phase 2- the long awaited I129F...Any ideas how long I'll expect to wait for THAT?? it's basically all the same as the I130 so shouldn't take too long, I anticipate.. What should I expect to happen at his interview? like, can I be with him? at least at the embassy waiting room? I WANT TO (inshaallah)CELEBRATE WITH HIM- NOT WAIT FOR HIM TO FLY HOME TO TELL ME lol

You are on the IR1 path. DO NOT file an I-129F. It will not help you. What you are waiting for is NOT NOA1. That's the receipt notice. What you are overdue for is an approval notice for the I-130.

Facts are cheap...knowing how to use them is precious...

to the OP -

please do not file the I-129F at all - it will cause your case to be delayed another 6 months with USCIS.

I am gonna guess that on Tuesday, you can call into USCIS and learn of the approval on the I-130 (which is a good thing)

In about 22 calendar days after the I-130 approval date, start calling into NVC and chasing down yer casefile.

If you file the I-129f now, what will happen is your I-130 will be put back in line along with the I-129f!! That means you'll be starting over again!

I think you've misunderstood the process. NO I-129f IS NEEDED/REQUIRED/ADVISABLE!

You are not waiting for NOA1, you already (I presume) have the NOA1 - The receipt from USCIS that they received your I-130 in August.

You're waiting for an I-130 approval (also known as the NOA2).
