USCIS made a mistake on NOA2 - do we need a new one?

Hi everyone,

We filed both the I130 and the I129F (for CR1 and K3 visa - we now know we should not have filed I129F...but too late!). And I have read somewhere on this forum that we shouldn't withdraw the I129F as it could cause a big mess and a big delay.

Both petitions were approved a few days ago, and my husband received NOA2 for both petitions yesterday.

The problem we have is that the I129F is correct and states that the petition has been forwarded to NVC. However, it is written on the I130 NOA2 that the beneficiary (me) is living in the US and that we are adjusting status, which is not what we're doing...

My husband, the US petitioner, called USCIS and he was told that it was just a mistake on the NOA2, but that our I130 petition will be sent to NVC. However, they refused to correct their mistake and to send us a corrected version of NOA2.

Is this going to be a problem in the future that we have a NOA2 that states that we are adjusting status? If so, what do we need to do to make them send us an updated version of the NOA2? How can we make sure that they are really sending the I130 petition to NVC (and to avoid NVC to begin processing the K3 visa)?

i say have the uscitizen petitioner call into uscis one more time, get an ISO, and ask the exact same questions again...
