i130 for brother

Hi everyone,

My sister is an us citizen through marriage and she has submitted i-130 for me 15 sept 2011.I know it takes ages to get the visa but uscis web site showing their texas service centre processing time is 5 months.my question is what is that 5 months and after approval how long it will take?i heard some one got the visa in 40 months.how could he get the visa that quick from same country?it has been nearly 9 months since she applied.does she need to do anything?

If anyone replies that would be very helpful.

You are at USCIS stage, and it only 6-8 months. The waiting time is at NVC stage, takes up to 10 years. Good luck.

I-130 petitions are not adjudicated at the service center in Texas, they are only adjudicated at the service centers in California or Vermont.

Based on the most recent visa bulletin, a visa will not be available for you for at least 11-12 years. The service centers tend to adjudicate petitions where visas are immediately available sooner than petitions where visas are not available for a significant amount of time.

Your sister does not need to do anything at this point. If she is sent a request for evidence (RFE), she will need to respond to it with the item(s) being requested. If the petition is ultimately approved by USCIS, it will be sent to the NVC where it will wait until a visa is available for your category (F4).

From what I understand that time period is for processing once you have a visa number. You would have to wait for the visa number to become available to even get an interview. So those processing times would not apply to your situation. Maybe this link will help.... bangladesh process times

Even with I-130 there are different visa category and each category has their own timeline. However the category for adult family members is the most time consuming. Don't forget that you have USCIS who validates the applications, does some background check and then NVC, who actually issues the visa. You already have these info from others in this thread :-). You will get away with the approval from USCIS on time (probably) but the waiting time to get the visa is really long. If you contact Bangladeshi US. Consulate they may tell you what year are they handling at this time. Or from other source I you find they are processing cases that were filed in 2002, you can assume there is a 10 year waiting.

What can be done to expedite this? I am pretty sure NOTHING.

Don't forget that you have USCIS who validates the applications, does some background check and then NVC, who actually issues the visa.

The section I put in red is incorrect nomenclature, USCIS doesn't "validate applications," they approve petitions, a petition is what was submitted to USCIS, not an application.

The section I put in bold is incorrect, the NVC does not issue visas, Embassies and Consulates issue visas. The NVC receives and reviews documents and sends files to appropriate Embassy or Consulate.

I forgot to attach a copy of my passport to my I130 for my brother, does anyone know what I need to do now?

hi,

the US passport is only needed to prove citizenship, if you sent something else for proof, such as copy of your birth certificate if you were born here, or copy of your certificate of naturalization, then you don't need to send it.

if you didn't send in any proof, then you will receive a RFE, request for evidence requesting to send what's missing
