hi

im male,came to USA 2003 on f1 visa, and then h1b in 2005,

i got married in may 2008, applied for papers in November 2008 , interview date for initial interview was July 2009 and i miss it because of trouble b/w me and my wife.

i don't wanna go through with my story of me being abused and all that

my quick question is am i eligible for vawa after 4 years of marriage ,im not divorced yet

i have all the paper work means

"marriage certificate

joint bank statement

joint lease

joint car insurance

marriage pictures

few pictures before marriage

marriage invitation card

wife birth certificate (prove of USA citizenship)

1 witness letter

2 friends recommendation letter

police clearance report

previously received documents from immigration

affidavit of me telling story

waiting for reply from anyone who know about what im talking about or professional

thanks

affidavit from a friend whose a witness of me getting abused and beat up by my wife at my friend house party

on 2 different ocassions

Agree with above. Do you have photos? Doctors reports? Unfortunately Affidavits from friends could be seen as lying, especially depending on your relationship timeline. It's been 3 years since you first filed so is there a removal order in place?

It's not going to be easy - I suggest you engage a lawyer.

I dont mean to scare you ,Its will be a tough process,more especially that you are in removal proceeding,have you appeared before a judge ? If not yet you better file your VAWA as soon as possible so that when you appear before him you can make mention of it being in the process ,do you know how long these proceeding started ? like NigeriaorBust has said its a little bit tough for men ,you need a lawyer if you can afford one to help you .All the best .

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If the violence happened more than two years ago you can't file the I-360.Never ever excuse violence and abusers.Each nine seconds someone is victim of violence domestic in the Usa. EVERY DAY two to three people are murdered by their spouses in the Usa, please stay safe and remain away from her.

Just a quick word I was married in 2005 and went through a year of abuse separated in 2006 and filed VAWA in 2010 and was approved yes you heard me approve I didn't know about VAWA in 2006 but I had a lot of evidence to back up my case. It was very hard living through that whole ordeal again but thank God I came out as the winner.
