I have been married for 3 years to a US citizen. I now have a permanent resident status for over a year. when i got married my daughter was not 21 but she was studying abroad. Now she has graduated last year. However,1 year ago I was also diagnosed with breast Cancer and needed my daughter to come over to assist as she is my only daughter. She came over on a B-1 Visa which allowed her stay for 6months. Within those 6 months, My cancer reoccurred to stage 4, I am being treated and needed my daughter assistance even more. So now she has been out of status for not quite 6 months. I want to know how can i go about applying for her as I am in dire need for her to stay with me.??

What is her age now? There is no immediately available visa for her.

You would petition for her and then wait for a visa to become available. If during that wait time you become a citizen then you can upgrade the petition and her place "in line" will move up.

If she chooses to stay out of status then she will not be eligible for work or likely a drivers license. And if she has to leave the US prior to obtaining a visa she would likely face a ban to re-entry. So your daughter should choose her path carefully.

You can find more info at the USCIS site. http://www.uscis.gov...000082ca60aRCRD Also, refer to the Visa Bulletin to learn the various wait times http://www.travel.st...letin_5692.html
