If you know of a way anchor babies result in free green cards for their parents - please share.

As far as I know, parents will not be allowed to stay regardless of having a US born child and no green card is free.

Edited to add: OP, if you lived in the US for 10 years, surely you know the situation here?

the eventual green card is unearned....the recipient did nothing unusual to acquire it except produce a child at taxpayer expense...that's what makes it 'free.' I never stated that parents of US born children can remain in the US legally (though many of them, when faced with deportation, try to point to said child as a means for staying put...something that should never be condoned)...all we need do is rewrite the 14th a bit...those who are here without permission or on temporary visas should derive no benefit from producing offspring within our borders...easy enough to legislate....we do it now with most foreign diplomats.

I know... but it would take 18 years at least, and it would not be free of charge. Meanwhile, parents would have to go back to the home country, because they could not AOS from illegal presence.

Income requirement also will need to be met for the affidavit of support and that implies excellent support network in the US for the said parents or lots of money in their home country... where if lots of money available, then why immigrate and wait 18 years for it?

Anchor babies make sense only in very limited circumstances.

Sorry, but the child has to be 21 before petitioning his/her parents...that I do know.

What is wrong with coming to the USA to have the baby delivered? I suspect the chances of complications during delivery are much lower in the USA than in India. So we should encorage that.

After reading few comments in this thread I begin to think that people put too much thinking into why the future mom (congrads!) will be denied entrance at the POE. What is wrong with the wife traveling to the USA with her husband? My wife often travel with me and I would encorage her to come more often. Do we have any statistics covering cases when an immigration officer refused an entry into the country to a pregnant woman because of a suspicion she will give birth on US soil?

Also, the other discussion that seems to be quiet misleading is related to potential hidden immigration agenda. I have a neighboor from Chile - she works as a clerk at city hall. Her son goes to city college. He was born in the USA. The mother does not have a green card, her tourist visa expired years ago. She has a driver license, SSN and a decent paying job. He has a great meaningfull life here (California).

Or simply look at Obama's uncle. He is undocumented, but has a job, broke the law by driving drunk, but still remains in the country.

I doubt you will have any problems. Again, congrads and hope you make the right decision that is best for you and your family.

What? You think that the US should give everyone in the world free health care? This person wants to travel here and get free medicaid to deliver her baby. You think more people should be encouraged to do this? How about we give everyone in the world free surgery too.

It is called birth tourism and CBP are on the lookout for it.

Most of the Doctors in the NHS are from India, many in the US as well.

I know there is a fare amount of Health Tourism to India, get your op at a fraction of the cost and have a holiday thrown in.

Unless there was something specific the US did in the way of unusual treatment, I can not think of any reason to come the other way.

I'm actually curious, how is your neighbor from Chile able to work legally in the US if she does not have a GC? How did she acquire her SSN?

She's not working legally. Perhaps fraudulently.

US is not the place where ppl just come to deliver the baby at cost of American Taxpayers.

I would 100% agree that 14th Amend should be ammended where undocumented and temp (tourist visa) mom when deliver should not get the US citizenship.

It would solve lot of the problems with illegal immigration, just coz I wish to go and have baby in some country I can do does not happen.

I pay taxes so my when my kids ready to go to school / college govt takes care of them, not someone who just came to US to have baby and never paid a dime to US govt in taxes.

By the way India has world class medical facilities, even lot of American insurance company give option to American patients to go to India to get surgery done.

If someone from India can afford to come all the way to US, I am sure they can afford those medical facilities in India.
