HI,

Please, I need help and information, as I am applying for green card for my parents here in the state. I am US Citizen and my my parents arrived here on 06mAY. Beside I-130, what other forms I need to send to USCIS along with i-130. Your help is really appreciated.

Did your parents use a tourist visa to enter the US with the intent to immigrate or are they planning to return home after a visit and have the interview in their home country?

Entering the US with a visitors visa with intent to immigrate is fraud and it is against the rules of this board to assist you with fraud

You file the I-130. They visit as long as their tourist visa allows and then return home to await the rest of the process, including the interview in their home country. After that they will be granted an IR-5 visa and return to America for good.

They can't stay and adjust status here. It's illegal, and USCIS will have no doubt about intent considering they arrived 2 days ago and you're filing papers already.

08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.

10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.

You have to file I-130 along with Form I-485, Application to Register Permanent Residence or Adjust Status. The requirement is your parents to be legal in US (tourist visa not expired). Check USCIS site for available information and fees.

Mom's case:

I-130 NOA2: 2012-03-30

Received at NVC: 2012-04-16

They came with intent to immigrate , he has posted the fact on this site, They could be looking at a lifetime ban if they try that

Adjusting is not the issue, what they said when they entered regarding the purpose of the visit.

Will it be an issue - probably not.

Is it an example of why it can be so difficult to get visa's from certain countries - absolutely.

Perhaps you should look up a B-2 visa on USCIS's website. Using a B-2 for the purpose of immigrating is illegal. AOS is allowed for when circumstances change. Unlikely OP's parents came over 2 days ago and in that time circumstances changed and now they need to stay.

As Boiler said it may not be an issue but it IS illegal, COULD be trouble depending on what they were asked at POE, and condoning it or suggesting how to commit fraud is against VJ TOS.

The parents entered as tourists 2 days ago according to the OP. That is the issue. They lied to the CBP officer.

What will happen? Who knows?
