NOTARIZED STATEMENT/CONSENT FROM BIOLOGICAL FATHER

Hi everyone!!! :) I am newbie on this site and I am so happy that I have a place to share my journey for CR1 and CR2 application... By this time we are waiting for the Notice of Appointment which is the Packet IV..I believe that I and my husband completed the requirements already..but I am just wondering if a NOTARIAL STATEMENT/CONSENT from my ex-husband is needed during embassy interview or might as well collected during POE admission since he is the BIOLOGICAL FATHER...It was not ask by the NVC but I have read some of the experiences here but mostly my questions in my mind we're not answered. My CHILD is 6 YEARS OLD and I do know that the full custody must be mine...It was not stated in our annulment/ court decision that the custody is mine but based on the Constitutional aspect here in our country(PHILIPPINES) states "The general rule is that a child under seven years of age shall not be separated from his mother, which is based on the basic need of a child for his mother’s loving care. Article 213 of the Family Code provides that “[n]o child under seven years of age shall be separated from the mother, unless the court finds compelling reasons to order otherwise.” This is more pronounced in case of illegitimate children, as the law expressly provides that illegitimate children shall be under the parental authority of their mother.

I already talked and visited DSWD about this and they advice me to do nothing since they will not ask any consent since I am the mother who will accompany my child in the travel...and I clarified Philippine Airlines(PAL) about the case and told me they will not ask as well...

I just hope somebody from the group could also share the same topic as mine, who underwent the interview already.PLEASE... :help:

Did the embassy ask NOTARIAL STATEMENT/CONSENT during the time of interview? I believe you will be screened by a Filipino interviewer before the Consul gets in...

Do we have to photocopy all documents needed on the interview?

Can somebody help please??? :help:

I was very prepared about that also but the consul didnt bother to ask for it,kahit sa imigration or dswd,but its better to prepare all the documents,from my experienced sobra akong nagworry but then everything went good naman. :thumbs:

That was great for you!! But I have the same issue with letter of consent from the father of my son.. We are not married though he was able to sign on the birth certificate of my son. My son now is 9 years old. So He is above 7 years old.. SOmeone advised me to better get a letter of consent from his father, but the problem is He is in Dubai right now. He is already married too..

Do I still need to get the letter.. Hope someone her could answer our questions.. Thanks a Lot!!! God Bless!:)
