Dear Sir/Madam,

My wife: US citizen, naturalized in 2002, did not fulfill the requirement of US residency of living in USA for 5 years; 2 of which when she was over 14 years-old.

Myself: LPR (GC holder)

1st child: Born in Canada and got US citizenship upon admission to USA according to Child Act 2000

Question is: :wacko: :wacko: :wacko:

If we get our second child born in Canada, can we file for I-130 at USCIS in USA or do we have to file for it at US emabassy in Montreal? :innocent::bonk:

The answer is still the same. You need to file an I-130 for the child and wait for the process to finish.

You cannot file it in the US embassy in Canada they do NOT process DCF.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Thanks Inky, We did file for our first child at US Consulate General in Calgary. They do accept I-130 petitions and then forward them to US embassy in Montreal to get processed.

Do you know how long will it take to approve I-130 petition when received at USCIS centers?

I have another question: My wife did not fulfilled residency requirement to pass US citizenship to our children upon birth, but her mom did.

My mother-in-law was born in USA, lived there for 5 years when she was young, and she lived there for 2 years (non-continous) when she was over 14 years old, can she pass US citizenship for her grand children?

No she cannot pass citizenship to a grandchild.
