One thing you'll have to determine is whether or not you'll be using a lawyer for the K1, for AOS, ROC or only the first portion of the process. If you decide you'll do AOS by yourself then you might as well get to know the process now. You'll have to get a pretty good attorney to help you stay on top of everything; the next steps. When you're at K1/petition level, you'll still need to know about AOS since you need the NOA2. Too bad if you fired your lawyer and you have a hard time getting hold of that NOA2 when you need it and it comes as a surprise. Or they forgot to tell you when to file for ROC. Their lives aren't going to change if you get denied or they're doing things slowly.

However I won't advise against having a lawyer because I don't know your story, your country of origin or if anything else requires legal advise. I think the money is better off spent on an extra trip to see each other during the process or around the interview.

Odds are you'll end up checking your case status often anyways and wondering what's taking so long. Hang around VJ for a while, look at the flowcharts, read a few subjects in the K! section. Good luck no matter what you decide. : )

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

I was quoted $975 from a lawyer in New York city. Although I recommend to not get a lawyer. I went to immigration with my father since he had to renew his green card. And was told to not waste our money on a lawyer. Everything is basic and you just have to follow the guidelines. They said a lawyer is a waste of money because you have to fill everything out and get all the copies together. Then you had it over to the lawyer. The only thing the lawyer does is send it to the USCIS. Lawyers also tell you having a lawyer speeds up the process and you receive a visa faster. I spoke to 3 different USCIS employees who told me that is a lie. They don't know who has a lawyer or who doesn't until they actually receive the file on the desk and open it. I am in the middle of getting all my information together and in less then a week I have everything ready. I am just waiting for my travel agency to send me my itineraries. I recommend doing it on you own.

Thank u so much for the advice i really appreciate..i am still figuring out and reading it over and over so i write what is important coz i feel like it's a lil bit of stressful and a lot of work.

I just read many posts on this topic again. It is VERY overwhelming at first looking and reading VJ. I say give yourself a week or two and just study VJ. As one person gave great advice on mapping it out and filling out sample forms. I took ours an hour a time as I have some Attention Deficit and work many hours. As mentioned before I hired an attorney and he asked for more information than required based on VJ. I spend more hours already obtaining documents for him then what I have in this process so far. And all I am waiting for is my fiancee's 325, letter of intent and photo then I can insert her stuff, double and triple check then send off and let the nerves start lol.. I personally feel better going this route. It means more to me this time which feels good..... If you have extra cash and simply dont want to bother then give an attorney a shot. I personally did not have a good experience all around back in 2008 using attorney.

Good luck one again
