HELP!! Cancel K1? file CR1???

Dear VJ'ers. (Not sure where to post this but my case is in AP so I posted here)I need help in making some serious decision and need all your expert advice.

Background info: My Fiance and I have been engaged since Oct. 2010. I filed for K1 Feb 2011, he had his interview Nov 2011 and we r now in AP for 5+ months. I will be visiting him in July and since we have been engaged for 1.5 yrs, we are thinking of getting married and file for CR1 assuming his case is not approved by July...But we are totally confused and don't want to go thru this entire process all over again!!! Please share your advice for the following questions we have:

1. If I cancel K1 and file CR1 what are the chances for him to get AP again and how can we avoid it?

2. Is there a way for me to expedite CR1 process??? (He is not in any war zone so I cant use that, but there are political instability in the country. Also, I am a Speech-language pathologist and work with disabled children. I refuse to stay away from my fiance once we are married because I cant go thru this same pain twice so can I use my job in any way to show that my patients need me and they will face difficulty if I quit my job and go live in Bangladesh until his visa is approved. I will email president Obama if I have to!)

3.If We do decide do go CR1 route, how can I prepare now so I can file As soon as we are married. I want to file the next day if possible.

Please Please Please help me...I feel lost....

AP does not mean it would be denied. It only means it is in further review, and it seems fomr what II read here that often is a long period. I'd contact your COngressman/woman to get some answers (not that they might get anything more that you do, but if you don't even try...). You might be very close to a decision and a CR-1 would mean start over, inclusive to the wait, etc. Expediting a CR-1 takes major reasons, like financial hardship, a serious illness -very serious one- and the like.

July is almost around the corner and that is why I've mentioned Congresman, it would be best if you do a formal written request and follow up on the phone. Nothing might come out of it, but at the very least, you gave it a try.

In parallel, check the country (your country) forum here, as there would be additional and relevant information specific to that country, which is the most applicable information for you to make a decision.

1. Chances of AP again are pretty high and you can't avoid it.

2. Unlikely.

3. Read the guides but CR-1 will delay you at least for another year - more or less, while your AP may be over in next few days... I would keep bugging embassy...

USCIS could care less about this. If you quit your job thats your problem not theirs. No expedite because you choose to do that. You wont get an expedite based on political instablitity either. Thats something ALL countrys have and deal with.

Unless hes dying or your dying you really have no venue for expedite.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Thanks for your responses. I already had my congressman send an inquiry in March and the result was basically the same. "Necessary Administrative Processing"... I guess we may have to wait it out...but wanted to get Vj'ers opinion to see if there is something you all may know that I don't. There is still 2 months till July and so I posted this now so we can think before rushing into marriage and cancel K1. Please keep sharing you advice so we can decide, keeping all these facts in mind.

Hey I know you are upset and frustrated but if I was in ur shoe I would wait it out. The reason is that u would have to start all over which could be another year, even after that there is no gaurantee that ur case wont be put in AP again. Ur wait will be lot longer if u start all over again. Ur fiance been in AP for over 5 months already and should be close to getting out soon. Its just my opinion but of course only u know ur situation and wats best for u. I wish u the best of luck. You are always in my prayers. Keep me updated.

I REALLY REALLY REALLY advise against cancelling the K1 and trying for a CR1 - (don't get married either cuz that could screw things up for you too since the purpose of the K1 is so you CAN get married) - from everything I've read on this site you would be in for another year or two of waiting (seems like the visa process is taking longer and longer due to backlogs) and it does not sound like you are eligible to expedite...you would most likely get AP again too since you never gave your first AP a chance to finish... It's kind of like waiting in a super long line at the grocery store, getting fed up, and going to wait in another super long line that takes even longer... I know it's hard but just try to be patient...Bangladesh seems to get out of AP quicker than others like Pakistan...does your fiance have a really common name? That could be the hold-up - I'm pretty sure that's why we have been waiting for so long... I know that it stinks...but try to wait it out - you already know how hard this process is and you don't want to do anything to compromise it....

Thanks so much for keeping me in your prayer. I do the same for you as well :) It is very frustrating and I don't want to make any mistakes hence I`m asking you all for opinions. SO i guess best option is to wait......IshaAllah I pray we all get out of AP soon

I understand...it is so frustrating...my husband is also muslim, very common name, and travels a lot...he was born in UK and lives there now but grew up in Morocco which is a MENA country...another strike against us for the AP...stay strong! praying we all get out soon! Good Luck!

CR1 is far better than K1 visa.Although CR1 gives conditional green

card for 2years. If you already married for 2 years then the case

moved to IR1 & your beneficiary will get 10 yrs GC in states.

AP is normal & mandatory for male visa candidate of all muslims countries &

& it is especially for MENA countries like us. Bangladesh has common AP males.

So, you cant ignore this process either you apply for K1 Or CR1.

Before you decide to cancel K1 pls check again with embassy & envolved your senator

to know the exact situation of your case. If they still says same thing & you want

quit from this process then apply to cancel K1 to USCIC & file a form to revocation your current petition. When you planning to marry just remember you need to keep enough evidence for relationship like picture , emails , travel docs , hotel bill , marriage ceremony picwith family etc. Also prepare yourself to wait another one year for Cr1 visa approval.

I totally understand your frustration... COMPLETELY!!!!

But basically you haven't been denied just having to complete the background checks. That's all your waiting on.

If you do go visit and marry and withdraw this and refile CR1 then your looking at prob another year or longer instead of a few more months with your current petition.

And .... it won't stop AP and actually could increase the length of it due to the main checks being done prior to arrival... so that he can obtain a SSN and his conditional green card...

My suggestion... wait it out... go visit and enjoy being there and hopefully you will be buying an extra ticket on your way home!!!!
