Hi everyone. pls help me. I was gonna get a state id here in TX. but they didn't allow me because my I-94 has expired. They told me to get a new I-94 in the immigration office. I just want to know how much will it cost to get a new I-94 and if the state id is needed for the AOS interview? thank you very much = )

You can't just go and get a new I-94 because you have no reason to be given one. You don't need a state ID for AOS but you will need your passport. Once you have your green card you will be able to get your state ID.

I'd wait until GC in hand. The DPS has peculiar rules. Even with the EAD, you would only get an id valid only for 1 year; with the conditional GC, they would do it only for the valid period of the GC< that is 2 years. Secondary and maybe that does not matter in your case, they would make the id as the name in the passport (assuming you had a way of doing it, which at this point, is not possible) thus, they would not use the married name. But, if you come in with the EAD or GC< they will use that name.

When we went, they had all this special rules and the people there are not the most customer oriented if you know what I mean.

So we left and will get there once we have the GC.

In the meantime, is really not needed. For example, for CC, rarely would someone ask for an id, and they do, she shows the Polish id, usually that is enough. In the 6-7 months here, not eve nonce we had the need for a local id. We now do have the EAD and that is what we use for traveling for example. We take the passport, copy of marriage cert and NOA jus tin case, but so far no one has asked any questions or made any problems.

And there is no need of state id for AOS.

Too bad you were unable to get your Texas State ID before your I-94 expired. AOS does not require a State ID. It's nice to have as additional support during the AOS interview, because you can show both your's and your husband's ID listing the same address.

Here is what I found out that is required to get a driver's license/ID in Texas, and it appears that you may be able to get an ID when you receive your EAD/AP card (assuming you get it before the AOS interview):

To satisfy the identity verification requirement for a Texas driver license or identification card, every applicant must present either one piece of:

Primary Identification:

These items are complete within themselves and require no supporting instruments: These documents must contain the applicant's complete name and full date of birth.

Primary identification

Must include full name, date of birth, and photo

Accepted for identification without additional documentation

Texas driver license (DL) or identification certificate (ID) with photo and within two years of expiration date

Unexpired United States passport book or passport card

United States Citizenship Certificate or Certificate of Naturalization with identifiable photo (N-560, N-561, N-645, N-550, N-55G, N-570 or N-578)

Unexpired DHS or USCIS document The document must contain verifiable data and identifiable photo. Examples include:

US Citizen Identification Card (I-179 or I-197)

Permanent Resident Card (I-551)

Temporary I-551 (immigrant visa endorsed with adit stamp) and foreign passport

Temporary Resident Identification Card (I-688)

Employment Authorization Card (I-766)

U.S. Travel Document (I-327 or I-571)

Advance Parole Document (I-512 or I-512L)

I-94 stamped Sec. 208 Asylee with photo

I-94 stamped Sec. 207 Refugee with photo

American Indian Card (I-872)

Northern Mariana card (I-873)

Foreign Passport, visa (valid or expired), and Form I-94 with an undefined expiration date (e.g., duration of status).

Foreign Passport, visa (valid or expired) and Form I-94 with a defined expiration date.

Unexpired United States military ID card for active duty, reserve, or retired personnel with identifiable photo.

We were able to get ours by taking SS card, marriage certificate, passport, and NOA from AOS filing, they put it in her married name,first they said no, but i did some research online and saw that if you are in the AOS process and can prove it you are eligible for a state ID. I cant say if it works for a drivers license.
