question about the 2 year conditional thing

Timeline

When we go for our interview, we will have been married for about 1 year and 8 months. So my question is, will my husband still get a conditional green card? Or will the two years of conditional status start when he's approved? Basically, how does that work since we're so close to the 2 year mark?

5/16/2012 - Package delivered to Chicago Lockbox at 1:33pm

5/21/2012 - Email/text notifications received at 4:50 p.m.

5/26/2012 - NOA hard copies received for I-130, I-485 and I-765

6/19/2012 - Biometrics completed.

7/02/2012 - Text/email/hard copy notification of interview.

7/30/2012 - EAD card production ordered.

8/02/2012 - Interview @ 2:00

8/02/2012 - Email notification of GC production at 5:30pm

8/07/2012 - Second GC production email

8/07/2012 - EAD received.

8/08/2012 - GC mailed.

8/09/2012 - Welcome letter and I-130 approval letter received.

8/10/2012 - Green card received. :)

If it has not been 2 years he will get a 2 year green card. The residency date will start on the date his green card is produced and issued.

That may very well be worth it.

If your case is very straightforward it could be beneficial for you to wait a few months to get a ten year card. Save you some monies down the road. :dance:

No need to wait six months though...four should do it, if you are calculating 1 year 8 months.

i think the OP means that, if they wait another 6 months, their medical is no longer valid, requiring a new one to file.

21/2 - received NOA in mail for all 4 (130/485/765/131)

23/3 - biometrics scheduled -> did "early" walk-in on 21 March

06/4 - received email update, interview scheduled for 7th May

27/4 - received EAD

08/5 - email: approval one day after interview (7th May)

If it's almost $600 a to ROC and you guys don't mind waiting, it might be better to hold off and just pay for a new medical, as you won't have to pay for the shots again, just the appointment. AOS's are taking on average about 12 weeks right now, so calculate your time accordingly. We actually held off a few additional weeks in filing to try to time our interview right after our 2 year anniversary.

How long is the I-693 valid for? I had thought it was a year, but I don't know for sure. Anyhow, when does yours expire? If you time it so your interview is after your 2nd year anniversary, you will get the 10-year green card. Given a processing time of three months, and take a month off in case your case processes incredibly fast, and you could file in two months and still get a 10 year card. It all depends on when your I-693 expires.
